(APPLICATION OF LAWS).

No. 72 of 1977.

AN ACT to make Provision with respect to the Application of the Laws of the State in the Off-shore Area adjacent to the State, and for other purposes.

[Assented to 28th November, 1977.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. This Act may be cited as the Off-shore Short title.

Interpreta-

tion.

2. In this Act

"adjacent off-shore area" means both or either

of the following areas

(a) the area that is-

(i)  west of one hundred and twenty-nine degrees of East longitude, reckoning from the meridian of Greenwich; and

(ii)  within three nautical miles seaward of Western Australia;

(b) the area that is-

(i)  west of one hundred and twenty-nine degrees of East longitude, reckoning from the meridian of Greenwich; and

(ii)  between Western Australia and the outer limit of the territorial sea of Australia as it may be from time to time;

"law of the State" means any present or future law in force in the State whether written or unwritten and as in force from time to time and includes any instrument made under such a law save and except a law of the Commonwealth;

"nautical mile" means a distance of 1 852

metres.

Application

3. (1) It is hereby declared that

the adjacent

off-shore

(a) the provisions of every law of the State shall be taken to have effect in and in relation to the adjacent off-shore area as if that area were part of Western Australia; and

(b)

any reference in a written law of the State to Western Australia or to the State or to the jurisdiction or any other likereference shall be read as including a reference to the adjacent off-shore area.

(2) Nothing in subsection (1) of of this section shall be taken to limit the operation of any written law of the State intended to operate beyond the adjacent off-shore area.
