Occupational Superannuation Standards Regulations 2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Occupational Superannuation Standards Act 1987.

1.   Amendment

1.1   The Occupational Superannuation Standards Regulations are amended as set out in these Regulations.

2.   Regulation 4k (Periods for determination of reasonable benefit limits)

2.1   Paragraphs 4k (1) (a), (2) (a) and (4) (a):

Omit “February” and “9 months”, substitute “May” and “12 months” respectively.

2.2   Subregulation 4k (5):

Omit the subregulation, substitute:

“(5)

For the purposes of subsection 15k (8) of the Act, the period within which the Commissioner must revise a determination is:

  • (a)

    if the application for revision is received before 1 May 1991—the period of 12 months after the person has applied to the Commissioner for revision of the determination, reduced by the number of days from the beginning of 1 July 1990 to the end of the day on which the application was made; or

  • (b)

    if the application for revision is received on or after 1 May 1991—the period of 60 days after the person has applied to the Commissioner for revision of the determination.”.
