Regulations (No. 2) 2007

Made by the Governor in Executive Council.

1.            Citation

These regulations are the Occupational Safety and Health

2.           The regulations amended

The amendments in these regulations are to the Occupational
Safety and Health Regulations 1996*.

3.            Regulation 1.11 amended

Regulation 1.11(2) is amended by deleting "4 January 2005."
and inserting instead -
44 1 September 2005. ".

4.            Regulation 3.136 amended

Regulation 3.136(2) is amended by deleting "1.15" and inserting instead -

" 1.16 ".

5.            Regulation 5.1 amended

(1)	Regulation 5.1(1) is amended in the definition of "Material Safety Data Sheet" by deleting "(1994)" and inserting instead -
" (2003) ".
(2)	After regulation 5.1(2) the following subregulation is inserted -

(3)	Before 24 April 2008, despite the definition of "Material Safety Data Sheet" or "MSDS" in subregulation (1), a document that contains the information in relation to a substance that is required by the National Code of Practice for the Preparation of
Material Safety Data Sheets [NOHSC: 2011(1994)],
that code of practice, is taken to be a Material Safety
whether or not the document is in the form required by regulations.

6.            Regulation 5.7 amended

(1) Regulation 5.7 is amended as follows:

(a)	by inserting before "If" the subregulation designation "(1)";
(b)	by deleting "Appendix 5" and inserting instead - " Appendix 4 ";
(c)	by deleting "(1994)" and inserting instead -

(2003) ".

(2) At the end of regulation 5.7 the following subregulation is

inserted —

(2) Before 24 April 2008, a person may, instead of

notifying the Commissioner in the form mentioned in
subregulation (1), notify the Commissioner in the form
of Appendix 5 to the National Code of Practice for the
Preparation of Material Safety Data Sheets [NOHSC:
2011 (1994)].

7.            Regulation 5.11 amended

Regulation 5.11(1)(c)(ii) is amended by deleting "an MSDS" and inserting instead —

" a material safety data sheet ".
