Occupational Safety and Health Amendment

Regulations 2008

Made by the Governor in Executive Council.

Part 1 — Preliminary

1.             Citation

These regulations are the Occupational Safety and Health
Amendment Regulations 2008.

2.             Commencement

These regulations come into operation as follows:

(a) Part 1 — on the day on which these regulations are published in the Gazette (“Gazettal day”);
(b) Part 2 — on the day after Gazettal day;
(c) Part 3 — on 1 January 2009.

3.             The regulations amended

The amendments in these regulations are to the Occupational
Safety and Health Regulations 1996.

Part 2 — Amendments to commence on the day after

Gazettal day

4.             Regulation 3.61 amended

Regulation 3.61 is amended as follows:

(a) by deleting “clause 1.2” and inserting instead —

“ clause 1.1 ”;

(b) in paragraph (a) by deleting “clause 2.3.5” and inserting instead —

“ clause 2.3.4 ”.

5.             Regulation 3.62 amended

Regulation 3.62 is amended as follows:

(a) by deleting “clause 3.6, 3.7 or 3.8” and inserting instead —

“ clause 3.5, 3.6 or 3.7 ”;

(b) by deleting “clause 3.9.2” and inserting instead —

“ clause 3.8.3 ”.

6.             Regulation 3.64 amended

Regulation 3.64(2) is amended by deleting “clause 2.5.7” and
inserting instead —

“ clause 2.5.5 ”.

7.             Regulation 3.143 amended

Regulation 3.143 is amended by inserting after
subregulation (5) —

Penalty: the regulation 1.16 penalty.

8.             Regulation 5.31 amended

Regulation 5.31(1) is amended by deleting “subregulations (2)
and (3)” and inserting instead —

“ subregulation (2) ”.

9.             Regulation 5.63 amended

Regulation 5.63(1)(a) is amended as follows:

(a) in subparagraph (i) by deleting “30” and inserting instead —

“ 20 ”;

(b) in subparagraph (ii) by deleting “60” and inserting instead —

“ 50 ”.

Part 3 — Amendments to commence on 1 January

2009

11.           Regulation 3.62 replaced

Regulation 3.62 is repealed and the following regulation is
inserted instead —
3.62. Tester to record information on tag
A competent person who conducts under clause 3.5,
3.6 or 3.7 of AS/NZS 3012 a test on an item of portable
electrical equipment or a portable residual current
device that is intended for use at a workplace must
ensure that, in addition to the information referred to in
clause 3.8.3 of that Standard, the tag bears —

(a) the person’s name; and

(b)

if the person holds an electrical worker’s licence issued under the Electricity (Licensing) Regulations 1991, the person’s licence number.

Penalty:

(a) for a first offence, $2 000; and
(b) for a subsequent offence, $2 500.

”.

12.           Regulation 3.63 amended

Regulation 3.63(b) is amended by deleting “licence number of
the electrical worker” and inserting instead —
“ name of the competent person ”.
