Part 1—Preliminary
1—Short title
These regulations may be cited as the Occupational Health, Safety and Welfare Variation Regulations 2004.
2—Commencement
These regulations come into operation on the day on which they are made.
3—Variation provisions
In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

4—Variation of regulation 1.1.5—Interpretation
Regulation 1.1.5(1)—after the definition of dB(A) insert:
dB(C) means decibels of C-weighted sound pressure level;
Regulation 1.1.5(1), definition of dB(lin)—delete the definition
5—Variation of regulation 2.10.2—Duties of designers, manufacturers, suppliers and importers
Regulation 2.10.2(1)(a)—delete " 85dB(A)" and substitute:
85 dB(A)
Regulation 2.10.2(1)(b)—delete paragraph (b) and substitute:
(b)a C-weighted peak sound pressure level, LC,peak of 140 dB(C) referenced to 20 micropascals.
6—Variation of regulation 2.10.3—Duties of employers
Regulation 2.10.3(1)(a)—delete " LAeq,8h of 90 dB(A)" and substitute:
LAeq,8h of 85 dB(A)
Regulation 2.10.3(1)(b)—delete paragraph (b) and substitute:
(b)a C-weighted peak sound pressure level, LC,peak of 140 dB(C) referenced to 20 micropascals.
Note—
As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
