REGULATIONS 1995

1. These regulations may be cited as the Occupational Health, Safety and

Principal regulations

2.     In these regulations, the Occupational Health, Safety and Welfare

Regulations 19884 are referred to as the principal regulations.

Regulation 322 amended

3.     (1) Regulation 322 (2) of the principal regulations is amended by

deleting `Worksafe Australia's National Exposure Standards (NOHSC: 1003

(1991)) and substituting the following —

Adopted National Exposure Standards for Atmospheric Contaminants in the Occupational Environment (NOHSC: 1003 (1995)) of the National Occupational Health and Safety Commission ))

(2) Regulation 322 (2b) of the principal regulations is amended by deleting orksafe Australia's National Exposure Standards (NOHSC: 1003 (1991)) and substituting the following —

Adopted National Exposure Standards for Atmospheric Contaminants in the Occupational Environment (NOIISC: 1003 (1995)) of the National Occupational Health and Safety Commission

Regulation 610 amended

4.     Regulation 610 (1) of the principal regulations is amended by deleting

"$25" and substituting the following —

" $50 ".
Regulation 1001 amended

5.     Regulation 1001 (1) of the principal regulations is amended in the

definition of "national standard" by deleting (1992)" and substituting the

following -

(1995)

Regulation 1006 amended

6.     (1) Regulation 1006 (1) of the principal regulations is amended by

deleting "certificates of competency" and substituting the following --

the categories or classes of certificates of competency set out in

the application form 71

(2) Regulation 1006 (3) of the principal regulations is amended by

inserting after "assessor" in the first place where it occurs the following —

for categories or classes of certificates of competency ".

Regulation 1006A inserted

7. The principal regulations are amended by inserting after regulation 1006

the following regulation —

Variation of registration

1006A.. (1) A person who is registered as an assessor may, in a form approved by the Commissioner, apply to the Commissioner —

(a) for a change to be made to a category or class of certificate of competency for which the assessor is registered; or
(b) for a category or class of certificate of competency to be added to the categories or classes of certificate for which the assessor is registered.

A person who applies under subregulation (1) shall include with the application the application fee set out in item 3A of Part 2 of Schedule 11, which is not refundable if the application is unsuccessful.

(2)

The Commissioner may change or add to the category or class of certificate of competency for which an assessor is registered if the Commissioner, having regard to the qualifications referred to in regulation 1006 (3), is satisfied that it is appropriate to do so.

A change or addition to a category or class of certificate

of competency for which an assessor is registered does not affect
the period for which the assessor is registered.

Schedule 11 amended

8.     Schedule 11 of the principal regulations is amended in Part 2 by

inserting after item 3 the following item —

3A. Application for variation of registration

as an assessor — for each category or class

(reg. 1006A (2)) $100.00
