The Australian Capital Territory Executive makes the following regulations under the Machinery Act 1949, the Scaffolding and Lifts Act 1912 and the Scaffolding and Lifts Act 1957.

Commencement
These regulations commence on the commencement of regulation 2 of the Occupational Health and Safety (Certification of Plant Users and Operators) Regulations 2000.
part 2—amendments of boilers and pressure vessels regulations
Regulations amended in pt 2
This Part amends the Boilers and Pressure Vessels Regulations.
Substitution
Regulations 1, 2 and 4 are repealed and the following regulations substituted:
1 Name of regulations“
These regulations are the Boilers and Pressure Vessels Regulations 1954.
2 Dictionary“
The dictionary at the end of these regulations is part of these regulations.
Note 1 The dictionary at the end of these regulations defines certain words and expressions used in these regulations.
Note 2 A definition in the dictionary applies to the entire regulations unless the definition, or another provision of the regulations, provides otherwise or the contrary intention otherwise appears (see Interpretation Act 1967, s 11F and s 11G, as applied by the Subordinate Laws Act, s 9).”.
Interpretation
Regulation 5 is amended—
(a)by omitting the definition of boiler attendant’s certificate; and
(b)by omitting from the definition of registered number “Part 4” and substituting “regulation 24”.
Relocation
Relocate all the definitions (except the definition omitted by regulation 4) to the dictionary.
Repeal
Repeal the remainder of regulation 5.
Repeal of pt 4
Part 4 is repealed.
Substitution
Regulation 48 is repealed and the following regulation substituted:
48 False representation“
A person must not make a false representation in connection with the issue of a certificate of inspection.”.
Insertion
Add at the end the following heading:
DICTIONARY“ (See reg 2)”.

Regulations amended in pt 3
This Part amends the Scaffolding and Lifts Regulations 1950.
Use of lifts
Regulation 68 is amended by omitting subregulation (1).
Change of ownership
Regulation 70 is amended by omitting from paragraph (b):
“ ‘Section 11 of the Scaffolding and Lifts Act, 1912-1948, requires that passenger lifts other than automatic lifts be in the charge of “authorised attendants” ’.”.
Commercial type hoists
Regulation 138 is amended by omitting subregulation (11).
Repeal
Parts XIV and XV are repealed.
