(AMENDMENT) ACT 1994 NO. 5—PROCLAMATION

A. M. Gleeson the Governor:

I. Rear Admiral PETER ROSS SINCLAIR, A.C., Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Occupational Health and Safety Legislation (Amendment) Act 1994, do, by this my Proclamation, appoint 1 August 1994 as the day on which the following provisions of that Act commence:

• Schedule 1 (3), (3, (9), (10) and (1 1) (except so much of item (1 1) as would insert clause 3), and section 3 in its application to those provisions;

• Schedule 3 (6), (7), (9). (11), (16)–(22), (24) and (25)–(27), and

section 5 in its application to those provisions;

• Schedule 4 (14) and (16), and section 6 in its application to those

provisions.

EXPLANATORY NOTE

The objects of this Proclamation are to commence:

• certain amendments to the Occupational Health and Safety Act 1983 contained in the Occupational Health and Safety Legislation (Amendment) Act 1994 relating to civil liability, workplace disruptions and industry codes of practice; and

• certain amendments to the Factories. Shops and Industries Act 1962 relating to proceedings for offences and matters in the nature of statutory law revision; and

• certain amendments to the Dangerous Goods Act 1975 relating to proceedings

for offences.

The provisions which remain uncommenced relate principally to the appointment and functions of certain inspectors in relation to the Occupational Health and Safety Act 1983, the Construction Safety Act 1912, the Factories, Shops and Industries Act 1962 and the Dangerous Goods Act 1975.
