Name of regulation
This regulation is the Occupational Health and Safety (General) Amendment Regulation 2008 (No 1).
Commencement
This regulation commences on the day after its notification day.
NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

This regulation amends the Occupational Health and Safety (General) Regulation 2007.
NoteThis regulation also amends the Magistrates Court (Occupational Health and Safety Infringement Notices) Regulation 2004 (see s 10 and s 11).

Employer to protect site of dangerous occurrence
Section 85 (1)

(1)This section applies if an employer is required to give the chief executive notice of a dangerous occurrence under the Act, section 204 (1) (d).
(1A)The employer must ensure that the site where the dangerous occurrence happened is not entered or otherwise disturbed––
(a)for 72 hours; or
(b)until an inspector directs otherwise.
Maximum penalty: 10 penalty units.
