Occupational Health and Safety (Commonwealth Employment) (National Standards) Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Occupational Health and Safety (Commonwealth Employment) Act 1991.

1.   Amendment

1.1   The Occupational Health and Safety (Commonwealth Employment) (National Standards) Regulations are amended as set out in these Regulations.

[NOTE:  These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 4.02 (Application of Part 4)

2.1   Subregulation 4.02 (7):

Omit the subregulation, substitute:

(7) Unless the contrary intention appears, this Part applies to:

  • (a)

    the use, repair or disposal of plant, whether manufactured before or after the commencement of this Part; and

  • (b)

    hazard identification, risk assessment and the control of risk in relation to plant, whether manufactured before or after the commencement of this Part.”.

3.   Regulation 4.40 (Licence to operate certain plant)

3.1   Subparagraph 4.40 (1) (b) (i):

Omit the subparagraph.

4.   Regulation 4.43 (Grant and renewal of a licence)

4.1   Subparagraph 4.43 (1) (a) (i):

Omit “types of plant”, substitute “items of plant”.

4.2   Paragraph 4.43 (3) (a):

Omit the paragraph.

5.   Schedule 6 (Items of plant)

5.1   Item 1 of Part 2:

Omit “A, B, C or D”, substitute “A, B or C”.

5.2   Paragraph (c) of item 2 of Part 2:

Omit “serially produced”, substitute “serial produced”.
