Occupational Health and Safety Amendment (Incident Notification) Regulations 2024

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Occupational Health and Safety Regulations 2017 to ensure that the Victorian WorkCover Authority is notified of incidents involving the collapse, overturning, failure or malfunction of, or damage to, prescribed plant.

2Authorising provision

These Regulations are made under section 158 of the Occupational Health and Safety Act 2004.

3Commencement

These Regulations come into operation on 1 July 2024.

4Principal Regulations

In these Regulations, the Occupational Health and Safety Regulations 2017[1] are called the Principal Regulations.

5Regulation 124 substituted

For regulation 124 of the Principal Regulations, substitute

"124   Notice of prescribed incidents

For the purposes of section 37(2)(e)(i) of the Act, plant referred to in regulation 74(1)(b), (c), (d), (e), (g), (h), (i), (j) and (k) is prescribed.".

6Recognition of other labelling systems

(1)In regulation 150(1)(e)(ii)(A) of the Principal Regulations, for "Part 4, Schedule 4" substitute "Schedule 4".

(2)In regulation 150(1)(e)(ii)(B) of the Principal Regulations, for "Part 4, Schedule 8" substitute "Schedule 8".
