NEW SOUTH WALES
[Published in Gazette No. 67 of 7 June 1996]
HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Occupational Health and Safety Act 1983, has been pleased to make the Regulation set forth hereunder.
J. W. Shaw
Minister for Industrial Relations.
Commencement
l. This Regulation commences on 2 September 1996.
Amendment
2. The Occupational Health and Safety (Asbestos Dust) Regulation 1984 is amended by omitting from paragraph (a) of the definition of “excess asbestos dust” in clause 3 (1) the matter “1.0” and by inserting instead the matter “0.5”.
EXPLANATORY NOTE
The Occupational Health and Safety Act 1983 imposes obligations on employers to ensure that places of work are safe and without risks to health to employees or other persons at those places.
The Occupational Health and Safety (Asbestos Dust) Regulation 1984 provides that certain places of work are a risk to health if the persons who work at those places are exposed to excess asbestos dust.
This Regulation amends the Occupational Health and Safety (Asbestos Dust)
Regulation 1984 to reduce the concentration of certain airborne asbestos fibres required
in air before excess asbestos dust is regarded as existing in certain places of work.
This Regulation is made under the Occupational Health and Safety Act 1983, including section 45 (the general regulation making power) and section 46 (adaptation of Part 3).
