His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Occupational Health and Safety Act 1983.

Explanatory note

The object of this Regulation is to amend the Occupational Health and Safety (Penalty Notices) Regulation 1996, as a result of the commencement of the Road and Rail Transport (Dangerous Goods) Act 1997:

(a)

to remove functions conferred on officers relating to matters now administered by other authorities, and

( b )

to remove obsolete references to repealed provisions and update other references, and

( c ) to make a consequential amendment.

This Regulation is made under the Occupational Health and Safety Act

1983, including section 45 (the general regulation-making power).

1 Name of Regulation

This Regulation is the Occupational Health and Safety (Penalty

Notices) Amendment Regulation 1998.

2 Commencement

This Regulation commences on 20 April 1998.

  1. Amendment of Occupational Health and Safety (Penalty Notices) Regulation 1996

    The Occupational Health and Safety (Penalty Notices)

    Regulation 1996 is amended as set out in Schedule 1.

4 Notes

The explanatory note does not form part of this Regulation.

Schedule 1 Amendments

(Clause 3)

[1]        Clause 7 Authorised officers—dangerous goods offences

Omit clause 7 (2).

[2]      Clause 7 (3) (a)

Omit the paragraph. Insert instead:

(a) an officer of the Environment Protection Authority constituted under the Protection of the

Environment Administration Act 1991 appointed

as an inspector of dangerous goods under section 6
of the Dangerous Goods Act 1975,

[3]      Schedule 1 Penalty notice offences

Omit from Columns 2 and 3 the matter relating to clauses 4 (5) and 176 of the Dangerous Goods Regulation 1978 and various provisions of the Australian Code.
