His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Occupational Health and Safety

Explanatory note

The object of this Regulation is to amend Schedule 1 to the Occupational Health and Safety (Penalty Notices) Regulation 1996 to update a reference to section 18 (Designers, manufacturers and suppliers to ensure health and safety as regards plant and substances for use at work) of the Occupational Health and Safety Act 1983 as amended by the Occupational Health and Safety Amendment Act 1997. That Schedule lists, for the purposes of section 5 1B of the Act, provisions that create offences that may be dealt with by penalty notice.

This Regulation is made under the Occupational Health and Safety Act 1983, including sections 45 (the general regulation-making power) and 51B.

1 Name of Regulation

This Regulation is the Occupational Health and Safety (Penalty

Notices) Amendment Regulation 1997.

2 Commencement

This Regulation commences on 1 November 1997.

3 Amendment of Occupational Health and Safety (Penalty Notices) Regulation 1996

The Occupational Health and Safety (Penalty Notices)

Regulation 1996 is amended as set out in Schedule 1.

4 Notes

The explanatory note does not form part of this Regulation.

(Clause 3)

Schedule 1 Penalty notice offences

Omit “18 (2) and (3)” from the matter relating to the Occupational
Health and Safety Act 1983 in Column 2.
Insert instead “18 (l)”.
