CaseChat Overview and Summary
The primary legal issue before the commission was whether the agreement met the statutory requirements for approval and registration. Specifically, the commission needed to determine if the agreement was made in good faith and whether it provided for the proper management and administration of the workplace. Additionally, the commission assessed whether the agreement was suitable and whether it was free from any improper influence or coercion.
The commission found that the agreement was made in good faith and contained provisions that ensured proper management and administration of the workplace. The commission also determined that the agreement was suitable and did not contain any improper influence or coercion. As a result, the commission approved the Roy Hill AWU Greenfields Agreement 2014 and ordered that it be registered under the Fair Work Act 2009.
