PART I - PRELIMINARY

  1. CITATION

These Regulations may be cited as the Nursing Regulations.  (See back note 1)

  1. DEFINITIONS

In these Regulations, unless the contrary intention appears -

"application" means an application in pursuance of regulation 3;

"course" in relation to -

(a)a school of nursing for general nursing or midwifery nursing, means a prescribed course of study; and

(b)a training school for enrolled nursing, means a prescribed course of training;

"midwifery nursing" includes the care of a person from the time of conception through to the delivery of her baby and the continuing care of the mother and her baby during the puerperium;

"nominated principal" means the person who is nominated as being in charge of a school, consents to the nomination and is approved by the Board as the nominated principal of the school;

"puerperium" means the period of 6 weeks after childbirth;

"pupil nurse" means a person permitted to undertake a prescribed course of training at a training school;

"qualified nurse educator" means a nurse who holds an associate diploma, diploma or degree in nursing education;

"school" means a school of nursing or training school;

"student nurse" means a person permitted to undertake a prescribed course of study at a school of nursing;

"trainee" means a pupil nurse or student nurse.

PART II - SCHOOLS OF NURSING AND TRAINING SCHOOLS

  1. APPLICATION FOR APPROVAL OF SCHOOL OF NURSING OR TRAINING SCHOOL

The person in charge of an institution may apply to the Board for approval of the institution as a school for a specified category of nursing, by lodging with the Registrar -

(a)an approved form of application for approval in relation to the type of school and category of nursing applied for; and

(b)an approved form of consent to the nomination as the nominated principal in relation to the person who is nominated as principal in the approved form of application for approval.

  1. APPROVAL OF SCHOOL OF NURSING FOR GENERAL NURSING

(1)      Subject to subregulation (2), where an application for approval of an institution as a school of nursing for general nursing has been made, the Board may so approve the institution for the whole of the prescribed course of study for general nursing where -

(a)the nominated principal is a general nurse and has experience as a nurse satisfactory to the Board;

(b)the institution can provide the prescribed course of study for general nursing;

(c)the clinical experience which forms part of the prescribed course of study for general nursing shall be obtained at a hospital which has not less than 200 beds occupied by patients on a daily average and where not less than 100 general nurses are employed on a full-time basis and engaged in general nursing; and

(d)the institution is managed and conducted, and is equipped with a library and teaching facilities, satisfactory to the Board.

(2)      Where an institution does not comply with the requirements specified in subregulation (1)(b) or (c), the Board may approve the institution for a portion of the prescribed course of study.

  1. APPROVAL OF SCHOOL OF NURSING FOR MIDWIFERY NURSING

(1)      Subject to subregulation (2), where an application for approval of an institution as a school of nursing for midwifery nursing has been made, the Board may so approve the institution for the whole of the prescribed course of study for midwifery nursing where -

(a)the nominated principal is a general nurse and midwifery nurse and has experience as a nurse satisfactory to the Board;

(b)the institution can provide the prescribed course of study for midwifery nursing;

(c)the clinical experience which forms part of the prescribed course of study for midwifery nursing shall be obtained at a hospital which deals with at least 500 births every 12 months and where not less than 15 midwifery nurses are employed on a full-time basis and engaged in midwifery nursing and have experience in midwifery nursing satisfactory to the Board; and

(d)the institution is managed and conducted, and is equipped with a library and teaching facilities, satisfactory to the Board.

(2)      Where an institution does not comply with the requirements specified in subregulation (1)(b) or (c), the Board may approve the institution for a portion of the prescribed course of study.

  1. APPROVAL OF TRAINING SCHOOL FOR ENROLLED NURSING

(1)      Subject to subregulation (2), where an application for approval of an institution as a training school for enrolled nursing has been made, the Board may so approve the institution for the whole of the prescribed course of training for enrolled nursing where -

(a)the nominated principal is a general nurse and has experience as a nurse satisfactory to the Board;

(b)the institution can provide the prescribed course of training for enrolled nursing;

(c)the clinical experience which forms part of the prescribed course of training for enrolled nursing may be obtained at a hospital which has not less than 50 beds occupied by patients on a daily average and where not less than 25 general nurses are employed on a full-time basis and engaged in general nursing; and

(d)the institution is managed and conducted, and is equipped with a library and teaching facilities, satisfactory to the Board.

(2)      Where an institution does not comply with the requirements specified in subregulation (1)(b) or (c), the Board may approve the institution for a portion of the prescribed course of training.

  1. CONSENT TO BE NOMINATED PRINCIPAL

Where a person is no longer to be the nominated principal of a school or she is expected to be absent from the school for more than 21 days, she or the person in charge of the institution shall lodge an approved notice to that effect with the Board, together with an approved form of consent to be the nominated principal of the school signed by the person proposed to replace the nominated principal.

  1. FORM OF APPROVAL

Approval under regulation 4, 5 or 6 shall specify -

(a)whether the institution is approved for the whole or portion of a prescribed course of study or prescribed course of training, as the case may be;

(b)the maximum number of trainees who may attend at the institution for a course at any one time;

(c)the person approved as the nominated principal; and

(d)other conditions of approval as the Board thinks fit.

  1. CANCELLATION OF APPROVAL

The Board may cancel its approval under regulation 4, 5 or 6 where, in its opinion -

(a)the nominated principal has failed to comply with the Act, these Regulations or a condition of the approval of the institution;

(b)a prerequisite for approval of the institution as a school for the whole or part of a course is no longer fulfilled; or

(c)approval of the institution was obtained by fraud or misrepresentation.

  1. MEMBER MAY ENTER SCHOOL

After notifying the nominated principal of its or her intention to do so -

(a)the Board shall, at least every 12 months; and

(b)a member may, at any reasonable time,

enter a school and inspect areas and records in relation to trainees.

PART III - DUTIES OF NOMINATED PRINCIPAL

  1. COURSES TO COMPLY

The nominated principal of a school shall ensure that a course at the school complies with these Regulations in relation to the course.

  1. REGISTER OF PERSONS ENGAGED TO TEACH, &c.

The nominated principal of a school shall keep a record of the name, qualifications and professional address of a person engaged in teaching at the school.

  1. ADMISSION OF TRAINEES

(1)      Subject to subregulation (2), the nominated principal of a school shall not permit a person to undertake a course unless -

(a)in the case of a school of nursing for general nursing, the person has -

(i)attained 17 years of age and satisfactorily completed year 12 of secondary education;

(ii)graduated, with credit, in the Course of General Studies for Aborigines at the Institute of Technical and Further Education established under the Northern Territory University Act (or, in relation to a time earlier than 1 January 1989, the Darwin Institute of Technology) and been awarded the Certificate for that course with the Certificate endorsed "A" level;

(b)in the case of a school of nursing for midwifery nursing, the person is a general nurse and has attained 20 years of age; or

(c)in the case of a training school for enrolled nursing, the person has attained 17 years of age and satisfactorily completed year 9 of secondary education,

and

(d)the person has produced references in relation to her good character from 2 other persons not related to her but well acquainted with her;

(e)the person has produced a certificate from a medical practitioner that she is of such a state of health that no danger would be involved to a patient with whom she is likely to be in contact as a trainee; and

(f)where the person has changed her name, provide documentary evidence of that change.

(2)      The Board may allow the nominated principal to permit a person to undertake a course or portion of a course although the person has not completed the necessary secondary education for the category of nursing, where the person has attained 21 years of age and has recently obtained experience satisfactory to the Board.

  1. NOTIFICATION IN RELATION TO TRAINEES

(1)      The nominated principal of a school shall, in writing, notify the Board, where -

(a)she permits a person to undertake a course, of the name, age and residential address of the person; or

(b)a trainee discontinues with her course.

(2)      For the purposes of subregulation (1), a notice shall be sent to the Board within 28 days of the person undertaking or discontinuing the course.

  1. RECORDS OF TRAINEES

The nominated principal of a school shall maintain a continuous record, in an approved form, of the subjects of a course which a trainee has completed and the clinical experience gained by the trainee.

PART IV - NURSING SYLLABUS

  1. PRESCRIBED COURSES OF STUDY FOR GENERAL NURSING

The prescribed courses of study for general nursing
are -

(a)a course at a school of general nursing for at least 3 years in which the subjects specified in Schedule 1 are covered for the number of hours appearing opposite the subject, the clinical experience specified in Schedule 2 is obtained and the skills specified in Part 1 of Schedule 3 are mastered in accordance with Part 2 of that Schedule; or

(b)the course of study provided by the Northern Territory University for the Diploma of Applied Science (Nursing).

  1. [Repealed]

  1. PRESCRIBED COURSE OF STUDY FOR MIDWIFERY NURSING

The prescribed course of study for midwifery nursing is a course at a school of nursing for midwifery nursing for at least 12 months in which the subjects specified in Schedule 4 are covered for the number of hours appearing opposite the subject, the clinical experience specified in Schedule 5 is obtained and the skills specified in Schedule 6 are mastered.

  1. ABSENCE FROM PRESCRIBED COURSE OF STUDY FOR MIDWIFERY NURSING

(1)      Subject to subregulation (2), a student nurse has not completed a prescribed course of study for midwifery nursing where she is absent from the course for more than 10 days sick leave in a 12 month period of the prescribed course of study unless she continues on her course for the equivalent period of her absence in excess of the 10 days.

(2)      Where a student nurse is absent from a pre-scribed course of study for midwifery nursing for periods totalling more than 28 days in a 12 month period, the nominated principal shall not permit the student nurse to continue on her course unless the student nurse has obtained the approval of the Board to do so.

  1. PRESCRIBED COURSE OF TRAINING FOR ENROLLED NURSING

The prescribed course of training for enrolled nursing is a course at a training school for at least 12 months in which the subjects specified in Schedule 7 are covered for the number of hours appearing opposite the subject and the clinical experience specified in Schedule 8 is obtained.

  1. ABSENCE FROM PRESCRIBED COURSE OF TRAINING FOR ENROLLED NURSING

(1)      Subject to subregulation (2), a pupil nurse has not completed a prescribed course of training for enrolled nursing where she is absent from the course for more than 10 days sick leave in a 12 month period of the prescribed course of training unless she continues on her course for the equivalent period of her absence in excess of the 10 days.

(2)      Where a pupil nurse is absent from a prescribed course of training for enrolled nursing for periods totalling more than 28 days in a 12 month period, the nominated principal shall not permit the pupil nurse to continue on her course unless the pupil nurse has obtained the approval of the Board to do so.

PART V - LECTURES AND EXAMINATIONS

  1. LECTURES

Where a lecture or demonstration is part of a course at a school, the nominated principal of the school shall ensure that the lecturer or demonstrator is -

(a)a qualified nurse educator;

(b)a nurse with teaching qualifications or other approved expertise;

(c)a medical practitioner; or

(d)a person with approved qualifications.

  1. EXAMINATIONS

(1) For the purposes of sections 12(2) and 13(c) of the Act -

(a)an examination in accordance with this regulation; or

(b)an examination set by the Northern Territory University in relation to the course of study for the Diploma of Applied Science (Nursing),

is a prescribed examination.

(2)      The Board may -

(a)set or cause to be set on its behalf written examinations; and

(b)undertake or cause to be undertaken oral and practical examinations,

in relation to a category of nursing.

(3)      An examination in relation to a category of nursing shall not cover a subject or test a skill which is not part of the course for the category of nursing.

  1. BOARD TO NOTIFY DATES OF EXAMINATIONS

(1)      The Board shall notify the nominated principal of a school of the dates of examinations to be conducted by the Board or on its behalf and the closing dates for applications to sit for the examinations.

(2)      Notification under subregulation (1) shall be in writing and at least 8 weeks before the date of the first examination to be conducted.

  1. NOMINATED PRINCIPAL TO NOTIFY DATES OF EXAMINATIONS

Where the nominated principal of a school receives a notice under regulation 24, she shall, as soon as prac-ticable, cause copies of the notice to be displayed or distributed in the school so that all trainees, who may be eligible to sit for an examination in a category of nursing, are made aware of the dates of examinations for the category of nursing

  1. ELIGIBILITY FOR EXAMINATION

A person is eligible to sit for an examination in a category of nursing -

(a)after satisfactorily completing a course in relation to the category of nursing;

(b)where the person may complete a course between the dates upon which consecutive examinations for the category of nursing are to be held and the Board approves of her sitting for the examination before completing her course;

(c)where the person has received a nursing education outside the Territory similar to the course for the category of nursing in the Territory and the Board approves of her sitting for the examination; or

(d)where the Board has allowed the nominated prin-cipal of a school to permit, in pursuance of regulation 13(2), a person to undertake a portion of a course and the person has completed the portion of the course.

  1. NOTIFICATION OF ELIGIBLE APPLICANTS FOR EXAMINATION

The nominated principal of a school shall, in writing, at least 6 weeks before the date of an exami-nation in a category of nursing, notify the Board of the names of the trainees who will be eligible to sit for the examination and the examinations for which each of them will be eligible to sit.

  1. APPLICATION FOR EXAMINATION

(1)      A person who will be eligible to sit for an examination in a category of nursing may lodge with the Board, at least 28 days before the date of the examination -

(a)an application in an approved form; and

(b)a fee, determined by the Minister, which may be refunded if the person is not permitted to sit for the examination.

(2)      Where the Board receives an application under subregulation (1), it shall allow the applicant to sit for an examination in a category of nursing where she is eligible under regulation 26
and -

(a)has not failed more than 2 examinations in the category of nursing within the preceding 12 months; or

(b)has failed more than 2 examinations in the category of nursing within the preceding 12 months but has undertaken further education or training satisfactory to the Board.

  1. BOARD TO NOTIFY DETAILS OF EXAMINATIONS

The Board shall, in writing, at least 14 days before the date of an examination in a category of nursing, notify -

(a)each person who has applied under regulation 28 and who, in its opinion, is eligible to sit for the examination in the category of nursing; and

(b)the nominated principal of each school,

of the date, time and place where the examination in the category of nursing shall be held.

  1. BOARD TO NOTIFY RESULTS

The Board shall, as soon as practicable after the results of an examination in a category of nursing are determined, in writing, notify  each  candidate of her results and the nominated principal of a school of all results of trainees at the school.

  1. CERTIFICATE OF COMPLETION

Where a person -

(a)has passed an examination in a category of nursing;

(b)completed a course in the category of nursing; and

(c)has not been convicted of an offence against the Nursing Act or these Regulations,

the nominated principal of the school at which the person completed her course shall issue a certificate of com-pletion, in an approved form, in the category of nursing.

PART II - REQUIREMENTS AS TO SKILLS TO BE MASTERED

  1. A student nurse is required to master 2 skills from each of Groups A, B, C and D in Part I before pro-ceeding to enter the third and final year of a course.

  1. In the third and final year of a course a student nurse is required to master -

(a)4 skills from Group E in Part I; or

(b)2 skills from Group E and 2 skills from Group F in Part I.

  1. Mastery of skills referred to in item 2 will be assessed in a total patient care situation.

  1. A student nurse is required to master 12 clinical skills.

(b)in Group B - Conduct of a Normal Delivery;

(c)in Group C - Breast Feeding - Supervision and Instruction; and

(d)in Group D - Examination of the Newborn,

is a compulsory skill.
