REGULATIONS UNDER THE NURSING HOMES ASSISTANCE ACT 1974*

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Nursing Homes Assistance Act 1974.

AMENDMENTS OF THE NURSING HOMES ASSISTANCE REGULATIONS 

 

Commencement

1.These Regulations shall come into operation on 14 October 1977.

2.Regulation 3 of the Nursing Homes Assistance Regulations is repealed and the following regulation substituted:

Interpretation

“ 3. In these Regulations—

‘ extensive care patient ’, in relation to a nursing home, means a qualified nursing home patient in that nursing home who is approved by the Permanent Head under section 13a of the Act, in relation to that nursing home, as a person requiring extensive care;

‘ ordinary care patient ’, in relation to a nursing home, means a qualified nursing, home patient in that nursing home, not being a person who is an extensive care patient in relation to that nursing home;

‘ the Act ’ means the Nursing Homes Assistance Act 1974.”.

3.Regulation 6 of the Nursing Homes Assistance Regulations is repealed and the following regulation substituted:

Rate for the purposes of paragraph 13 (1) (d) of the Act

“ 6. For the purposes of paragraph 13 (1) (d) of the Act, the rate applicable to a qualified nursing home patient in a nursing home situated in a State or Territory specified in column 1 of the following table is—

(a) in the case of an ordinary care patient—the amount per week specified in column 2; and

(b) in the case of an extensive care patient—the amount per week specified in column 3,

of that table opposite the name of that State or Territory specified in column 1:

Schedule 2

4.Schedule 2 to the Nursing Homes Assistance Regulations is amended—

(a) by omitting “ Benevolent Homes Association (Q’ld.) ” and substituting “ Voluntary Care Association (Q’ld.) ”; and

(b) by omitting “ The Tasmanian Association of Non-Profit Homes for the Aged ” and substituting “ Voluntary Care Association of Tasmania ”.
