s1 2 s6 Nursing Amendment (No. 2) No. 80, 1997 ˙ Short title 1. This by-law may be cited as the Nursing Amendment By-law (No. 2) 1997 . ˙ By-law amended 2. This by-law amends the Nursing By-law 1993 . ˙ Amendment of s 63 (Restoration of registration and enrolment) 3. Section 63(1), after ‘under’— insert— ‘the Nursing Act 1976 , section 31, or’. ˙ Replacement of s 64 (Annual licence fee—payment period) 4. Section 64— omit, insert— ˙ ‘ Annual licence certificate fee—payment period ‘ 64. For section 74(3) of the Act, the period in which the annual licence certificate fee must be paid is the period from 1 April to 30 June.’. ˙ Amendment of s 64A (Refund of proportion of annual licence fee) 5. Section 64A, heading, after ‘licence’— insert— ‘certificate’. ˙ Amendment of s 65 (Application for authorisation to practise) 6. Section 65— insert— ‘ (3) An application by a person who is not a nurse to practise midwifery must also be accompanied by the annual licence certificate fee stated in the

s7 3 s7 Nursing Amendment (No. 2) No. 80, 1997 schedule, part 1. ‘ (4) If an application mentioned in subsection (3) is refused, the council must immediately refund the annual licence certificate fee that accompanied the application.’. ˙ Amendment of schedule (Fees) 7.(1) Schedule, ‘65(2)’— omit, insert— ‘65(2) and (3)’. (2) Schedule, part 1— omit, insert— ‘ PART 1—FEES PAYABLE TO COUNCIL 1. Application for 1 or more of the following— (a) registration or temporary registration as a registered nurse; (b) enrolment as an enrolled nurse; (c) authorisation to practise midwifery, psychiatric nursing or nursing in another area or nursing . . . . . 2. Annual licence certificate fee— (a) on application for initial registration, enrolment or authorisation to practise midwifery, or on application for re-registration, re-enrolment or the re-issue of authority to practise midwifery— (i) if the application is received by the council from 1 July to 31 March . . . . . . . . . . . . . . . . . . . . . .
