REGULATIONS UNDER THE NURSES ACT, 1984

PART I

PRELIMINARY

1. These regulations may be cited as the Nurses Regulations, 1986.

2. These regulations shall come into operation on the fifth day of May, 1986.

3. These regulations are arranged as follows:

4. (1) In these regulations, unless the contrary intention appears—

"the Act" means the Nurses Act, 1984:

"authorized badge" means a badge issued under these regulations or under regulations made

in pursuance of the repealed Act:

"authorized person" means a person authorized by the Board to exercise the powers of an

authorized person under these regulations:

"nursing school" means an institution at which courses of instruction or training intended to qualify the students in whole or in part for registration or enrolment under this Act are, or are proposed to be, provided.

(2) For the purposes of these regulations, a person is unqualified if that person is neither registered nor enrolled under the Act.

PART II

REGISTRATION AND ENROLMENT

5. (1) An application for—

(a)

registration, or reinstatement of registration on the nurses’ register, the psychiatric nurses’ register, the mental deficiency nurses register or the midwives’ register;

(b)

enrolment or reinstatement of enrolment on the nurses’ roll;

or

(c)

reinstatement of enrolment on the mothercraft nurses’ roll,

must be in the appropriate form prescribed by the first schedule.

(2) The application must be accompanied by—

(a)

the supporting evidence and documents referred to in the application form;

(b)

the appropriate fee for—

(i)

registration or reinstatement of registration;

or

(ii)

enrolment or reinstatement of enrolment;

and

(c)

the practice fee.

6. (1) The prescribed qualifications for registration are as follows:

(a)

the qualifications in the second schedule are prescribed qualifications for registration as a general nurse;

(b)

the qualifications in the third schedule are prescribed qualifications for registration as a psychiatric nurse;

(c)

the qualifications in the fourth schedule are prescribed qualifications for registration as a mental deficiency nurse;

(d)

the qualifications in the fifth schedule are prescribed qualifications for registration as a midwife.

(2) The qualifications in the sixth schedule are prescribed qualifications for enrolment as a general nurse (supervised).

(3) Where the Board requires a person to sit for an examination, satisfactory performance in that examination is a prescribed requirement for registration or enrolment.

7. (1) The prescribed experience for registration as a general nurse is experience in each of the following fields of nursing—

(a)

general nursing care of patients with medical (non surgical) health problems;

(b)

general nursing care of surgical patients;

(c)

care of patients requiring high dependency nursing;

(d)

nursing care of patients requiring emergency treatment;

(e)

operating room nursing;

(f)

nursing care of patients requiring long term and residential care;

(g)

gerontic nursing care;

(h)

community nursing care;

(i) nursing care of persons with mental health problems;

(j)

nursing care of persons with intellectual disabilities;

(k)

nursing care of mothers and babies.

(2) The prescribed experience for registration as a psychiatric nurse is experience in each of the following fields of nursing—

(a)

nursing care of patients with acute mental health disorders;

(b)

nursing care of patients with long term mental health disorders;

(c)

nursing care of patients with psychogeriatric health disorders;

(d)

rehabilitative therapies and day care of persons with short term and long term mental health disorders;

(e)

nursing care of persons having substance abuse health problems as well as mental health disorders;

and

(f) community mental health care. (3) The prescribed experience for registration as a mental deficiency nurse is experience in

each of the following fields of nursing—

(a)

care of persons needing residential care by reason of intellectual disabilities;

(b)

care in the community for persons needing support by reason of an intellectual disability;

(c)

nursing care of intellectually disabled persons with associated health problems;

and

(d)

experience with intellectually disabled persons in schools and employment situations.

(4) The prescribed experience for registration as a midwife is experience in each of the following fields of nursing—

(a)

care of families in the ante natal period;

(b)

care of the mother, baby and family during labour;

(c)

care of the mother and baby immediately following delivery;

(d)

care of the mother, baby and family in the post partum period;

and

(e) community maternity care. (5) The prescribed experience for enrolment as a general nurse (supervised) is experience in

each of the following fields of nursing—

(a)

basic nursing care of patients with medical (non surgical) health problems;

(b)

basic nursing care of surgical patients;

(c)

basic long term nursing care;

and

(d)

gerontic nursing care.

Examinations

8. The Board may require a person who seeks to be registered or enrolled to sit for an

examination.

9. (1) As soon as practicable after conducting an examination the Board shall notify each candidate of the candidate’s results.

(2) Notification pursuant to subregulation (1) shall be by letter sent by ordinary post to the residential address of the candidate.

(3) In a letter sent to a candidate pursuant to subregulation (2) the Board shall indicate whether the candidate has passed or failed the examination.

10. (1) Subject to this regulation, a candidate who fails an examination may sit for a subsequent examination.

(2) A candidate who intends to sit for a subsequent examination shall—

(a)

apply in writing to the Board to be admitted as a candidate in a subsequent examination;

and

(b)

pay to the Board the examination fee.

(3) The Board may require a candidate to sit for the examination immediately following the examination failed by the candidate.

(4) No person shall sit for an examination in a particular course more than three times.

Certificates of Registration or Enrolment

11. The Board shall issue to each nurse a certificate of registration or enrolment in the appropriate form prescribed by the first schedule.

12. (1) If a certificate is lost or destroyed the nurse to whom the certificate is issued shall, as soon as practicable after becoming aware of the loss or destruction, notify the Board in writing of the circumstances of the loss or destruction.

Penalty:

$100.

(2) The Board may issue a duplicate certificate of registration or enrolment to a nurse who—

(a)

notifies the Board of the loss or destruction of a certificate under subregulation (1);

and

(b)

pays the fee for a duplicate certificate.

PART III

NURSING SCHOOLS

13. (1) The Board may approve a nursing school as a principal or affiliate nursing school.

(2) An approval under subregulation (1) shall be for a period determined by the Board.

(3) An application for approval or renewal of approval under this regulation must be supported by such documentary or other evidence as the Board may require.

(4) Where the Board approves or renews the approval, of a nursing school pursuant to subregulation (1), it shall issue a certificate of approval in an appropriate form.

14. (1) An approval may be granted by the Board under this Part on such conditions as the

Board thinks fit.

(2) The Board may, by notice in writing to an approved nursing school, vary or add to the conditions of approval.

15. (1) Subject to this regulation the Board may revoke or decline to renew an approval—

(a)

if, in the opinion of the Board, there are deficiencies in—

(i)

the syllabus of the course of studies conducted by the approved nursing school;

(ii)

the teaching facilities of the nursing school;

or

(iii)

the standard of the instruction or education offered at the nursing school;

or

(b)

if contravention of, or non-compliance with, a condition of the approval occurs.

(2) A nursing school shall deliver its certificate of approval to the Board within 14 days of the revocation or non—renewal of its approval.

Penalty:

$200.

(3) The Board may reinstate an approval if, in the opinion of the Board, the deficiencies on the basis of which the Board revoked or declined to renew the approval have been rectified.

16. An approved nursing school shall not admit a person as a student unless that person—

(a)

has a standard of education necessary to undertake the proposed course or studies at the nursing school;

and

(b)

is in a satisfactory state of health to be a student of the nursing school.

17. (1) Within one month after a person is admitted as a student of an approved nursing school the person in charge of the school shall notify the Board in writing of the following:

(a)

the full name and address of the student;

(b)

the date of birth of the student;

(c)

the studies being undertaken by the student;

(d)

the date of commencement of the studies being undertaken by the student;

(e)

the qualifications of the student at the time of admission to the school.

Penalty:

$200.

(2) Within one month after a student discontinues studies at an approved nursing school the person in charge of the school shall notify the Board in writing of the following:

(a)

the full name and full address of the former student;

(b)

the studies undertaken by the former student;

(c)

the date on which the former student discontinued studies at the school;

(d)

the reason for discontinuance of studies by the former student.

Penalty:

$200.

18. (1) Where a person has the possession or control of any books, papers or other documents in relation to any course or any studies conducted by an approved nursing school, an authorized person may request that person to produce the books, papers or other documents to the authorized person.

(2) A person who fails to comply with a request made under subregulation (1) is guilty of an

offence.

Penalty:

$1 000.

(3) An authorized person may examine any books, papers or other documents produced to the authorized person pursuant to a request under subregulation (1) and take extracts and make copies.

19. (1) An approved nursing school shall lodge an annual return with the Board in relation to each course of studies it conducts.

(2) Subject to subregulation (3) an annual return lodged under subregulation (1) must be for the year ending 31 December and be lodged with the Board before 28 February in each year.

(3) The Board may extend the period during which an annual return must be lodged under

subregulation (2).

(4) An annual return must contain the following information:

(a)

the full name of the nursing school;

(b)

the name of the director of nursing of the nursing school;

(c)

the number of students undertaking the course of studies;

(d)

the number of students admitted to the course of studies during the year ending 31 December;

(e)

the number of students who discontinued the course of studies during the year ending 31 December;

(f)

where students discontinue the course of studies during the year ending 31 December—a summary of the reasons given by the students for discontinuing the course of studies;

(g)

the number of students which the school proposes to admit to the course of studies during the 12 month period following the year ending 31 December;

(h)

the courses of studies in relation to nursing conducted by the school;

(i) the provision for continuing education of qualified staff;

(j)

the number and the qualifications of staff employed in the school;

(k)

the clinical experience available to students;

(l)

the teaching facilities available at the school;

(m)

any proposals by the administrators of the school for a review of the courses of studies;

(n)

changes to courses of studies since the previous annual return.

PART IV

GENERAL

20. (1) A reference in this regulation to another "State" is a reference to a State or Territory of the Commonwealth other than this State.

(2) A nurse who—

(a)

is employed as a nurse in another State;

(b)

is required as a condition of the nurse’s employment to practise nursing temporarily in this State;

(c)

is registered or enrolled as a nurse in the other State;

and

(d)

has paid the appropriate fees currently payable under the law of the other State in relation to—

(i)

practice;

and

(ii)

registration or enrolment as a nurse,

is exempted from the obligation to pay the prescribed registration and practice fees.

21. For the purposes of section 36 of the Act, the prescribed information is—

(a)

the full address of the nurse’s current place of work;

(b)

the full address of the nurse’s previous place of work (if any);

(c)

the full name and full business address of the nurse’s current employer;

(d)

the number of hours usually worked per week by the nurse when practising;

(e)

periods during the preceding 12 months during which the nurse was not practising;

(f)

the field of nursing in which the nurse is currently practising;

(g)

the position held by the nurse in the nurse’s current employment;

(h)

the fields of nursing in which the nurse has practised during the preceding 5 years;

(i) full details of any disciplinary action taken against the nurse in relation to practising as a nurse;

(j)

full details of the nurse’s qualifications.

22. For the purposes of section 39 of the Act, the prescribed information is—

(a)

the prognosis of the illness of the patient;

(b)

full details of any treatment being received by the patient for any mental or physical illness or disability;

(c)

full details of any form of nursing care that, in the opinion of the medical practitioner, the patient is unfit to provide by reason of any mental or physical illness or disability;

(d)

if the patient has received treatment for a mental illness—whether the patient has at any time been a voluntary or detained patient within the meaning of the Mental Health Act, 1977.

23. The Board may fix fees or charges for the following:

(a)

registration;

(b)

enrolment;

(c)

practice;

(d)

reinstatement of registration;

(e)

reinstatement of enrolment;

(f)

issue of duplicate documents;

(g)

assessment of nursing qualifications;

(h)

sale of badges;

(i) sale of publications;

(j)

examinations;

(k)

reports in relation to the performance of candidates in examinations;

(l)

preparation of statements verifying registration or enrolment;

(m)

inspection of a register or roll.

24. (1) A midwife who practises on premises other than hospital premises shall lodge with the Board an annual return containing the following information:

(a)

the midwife’s full name and full residential address;

(b)

the midwifery registration number allocated to the midwife by the Board;

(c)

a description of the midwifery practice undertaken by the midwife during the preceding 12 months;

(d)

the midwife’s full professional address (if any).

(2) An annual return lodged under subregulation (1) shall be for the year ending 30 June and be lodged with the Board before 31 July in each year.

25. (1) A midwife who intends to practise midwifery on premises other than hospital premises shall notify the Board in writing of the following:

(a)

the date on which the midwife intends to commence practice on premises other than hospital premises;

(b)

the midwife’s full name and current residential address;

(c)

full details of the midwife’s nursing qualifications;

(d)

the midwifery registration number allocated to the midwife by the Board;

(e)

the midwife’s full professional address or intended professional address (if any);

(f)

a description of the midwife’s nursing practice during the preceding 5 years;

(g)

a description of any physical or mental illness or disability that may impair the ability of the midwife to provide nursing care;

(h)

full details of any disciplinary action taken against the midwife in relation to the midwife’s practice as a nurse.

(2) A midwife shall notify the Board pursuant to subregulation (1) at least 6 weeks before commencing to practise midwifery on premises other than hospital premises.

26. (1) In this regulation—

"employee" means a person employed as a nurse:

"employer" means a person who employs a person to practise as a nurse.

(2) An authorized person may request an employer to produce to the authorized person all books, papers and other documents in relation to an employee that are in the possession or under the control of the employer.

(3) A person who fails to comply with a request under subregulation (2) is guilty of an

offence.

Penalty:

$1 000.

(4) An authorized person may examine books, papers or other documents produced in subregulation (2) and take extracts and make copies.

(5) A person who contravenes subregulation (3) is guilty of an offence and liable to a penalty not exceeding $1 000.

27. (1) In this regulation—

"agent" means a person who acts on behalf of another person, with or without reward, for

the purpose of procuring employment as a nurse for that other person:

"client" means a person on whose behalf an agent acts.

(2) An authorized person may request an agent to produce to the authorized person all books, papers and other documents in relation to a client that are in the possession or under the control of the agent.

(3) A person who fails to comply with a request under subregulation (2) is guilty of an

offence.

Penalty:

$1 000.

(4) An authorized person may examine books, papers or other documents produced pursuant to subregulation (2) and take extracts and make copies.

28. (1) An authorized person who reasonably suspects that a person who appears to be practising as a nurse is unqualified may request that person to produce to the authorized person evidence of that person’s registration or enrolment under the Act.

(2) If a person fails to produce evidence of registration or enrolment to an authorized person pursuant to a request under subregulation (1), the authorized person may request that person to state—

(a)

the person’s full name and full residential address;

(b)

the address of the person’s current place of work;

and

(c)

the full name and full business address of the person’s current employer.

(3) A person who fails to comply with a request under subregulation (2) is guilty of an

offence.

Penalty:

$ 1 000.

29. (1) The Board may issue to a person who is registered as a general nurse, a midwife, a mental deficiency nurse or a psychiatric nurse a badge—

(a)

in the appropriate form depicted in the seventh schedule;

and

(b)

with the shield in the centre of the badge inscribed as follows;

(i)

for a badge issued to a person who is registered as a general nurse, the letters "R.G.N.";

(ii)

for a badge issued to a person who is registered as a midwife, the letters "R.M.";

(iii)

for a badge issued to a person who is registered as a mental deficiency nurse, the letters "R.M.D.N.";

or

(iv)

for a badge issued to a person who is registered as a psychiatric nurse, the letters "R.P.N.".

(2) The Board may issue to a person who is enrolled as a general nurse (supervised) or as a mothercraft nurse a badge—

(a)

in the appropriate form depicted in the seventh schedule;

and

(b)

with the shield in the centre of the badge inscribed as follows:

(i)

for a badge issued to a person who is enrolled as a general nurse (supervised), the letters "E.G.N.";

or

(ii)

for a badge issued to a person who is enrolled as a mothercraft nurse, the letters "E.M.N.".

30. (1) No person other than a nurse shall wear an authorized badge.

(2) No nurse shall wear an authorized badge other than a badge appropriate to the field of nursing in relation to which the nurse is registered or enrolled.

(3) A person who contravenes subregulation (1) or (2) is guilty of an offence.

Penalty:

$1 000.

(4) An authorized person who reasonably suspects that a person is wearing a badge in contravention of subregulation (1) may request the person to produce to the authorized person evidence of that person’s registration or enrolment.

(5) An authorized person who reasonably suspects that a nurse is wearing a badge in contravention of subsection (2) may request the nurse to produce to the authorized person evidence of the nurse’s registration or enrolment in the field of nursing indicated by the letters inscribed on the shield in the centre of the badge.

(6) If a person fails to comply with a request made by an authorized person pursuant to subregulation (4) or (5) the authorized person may request that person to—

(a)

state the person’s full name and full residential address;

(b)

state the full address of the person’s current place of work;

and

(c)

state the full name and full business address of the person’s current employer.

(7) A person who fails to comply with a request under subregulation (6) is guilty of an

offence.

Penalty:

$ 1 000.
