NURSES REGISTRATION (AMENDMENT) ACT.

Act No. 18,1960.

An Act to make further provision with respect to the Elizabeth n,

registration o f nurses and the constitution of the

Nurses Registration Board; for this and other purposes to amend the Nurses Registration Act, 1953-1955; and for purposes connected therewith. [Assented to, 6th April, I960.]

T IE it enacted by the Queen’s Most Excellent Majesty, by

and with the advice and consent of the Legislative

Council and Legislative Assembly of New South Wales in

Parliament assembled, and by the authority of the same, as

follows: —

1.     (1) This Act may be cited as the “Nurses Registration short title

(Amendment) Act, 1960”.

The Nurses Registration Act, 1953, as amended

by subsequent Acts and by this Act, may be cited as the

Nurses Registration Act, 1953-1960.

2. The Nurses Registration Act, 1953, as amended by Amendment

(a)

by omitting paragraph (c) of section seven and bysec. 7. inserting in lieu thereof the following paragraph : — (Vacation

(viii)   by inserting in subparagraph (i) of paragraph (c) of the same subsection after the symbols “ (i)” the letter and symbols “ (a )” ;

(ix)   by omitting from subparagraph (ii) of the same paragraph the symbols “ (ii)” and by inserting in lieu thereof the letter and symbols “ (b)” ;

(x)   by inserting next after the same subparagraph the following new subparagraph : —

(ii)  she has attained the age of twenty-one years; and;

(xi)  by inserting in subparagraph (i) of paragraph (d) of the same subsection after the symbols “ (i)” the letter and symbols “ (a)” ;

(xii)   by omitting from subparagraph (ii) of the same paragraph the symbols “ (ii)” and by inserting in lieu thereof the letter and symbols “ (b)” ;

(xiii)  by inserting next after the same subparagraph the following new subparagraph : —

(ii)   she has attained the age of nineteen years; and;

(xiv)

by omitting from subsection two of the same No. 18, i960, inserting in lieu thereof the words “twenty-one years in the case of a general or midwifery nurse, the age of twenty years in the case of a mental nurse, and the age of nineteen years in the case of an infants’ nurse, and” ;

(xv)   by inserting in subsection three of the same section after the words “twenty-one years” the words “in the case of a general or midwifery nurse, the age of twenty years in the case of a mental nurse, and the age of nineteen years in the case of an infants’ nurse” ;

(xvi)   by omitting from paragraph (b) of subsection four of the same section the word and symbols “subparagraph (ii)” wherever occurring and by inserting in lieu thereof the words “paragraph (b) of subparagraph ( i )” ;

(c)

by inserting next after section sixteen the following New sec. new section : —

16a. (1) The Board may, at the request of any Temporary

person desirous of obtaining a certificate of ^fy

temporary registration and upon payment of the granted,

fee prescribed under subsection three of section

fifteen of this Act, grant to such person a certificate

of temporary registration in the prescribed form

upon being satisfied that such person—

(a)

is entitled to be registered under this Act; and

(b)

is interested in post-graduate teaching or research work in nursing or receiving post­ graduate tuition in nursing, or is desirous of obtaining a certificate of temporary registration for a purpose for which the Board considers the grant of such a certificate would be desirable.

A certificate of temporary registration may be granted unconditionally or subject to such conditions, including a condition as to the capacity in which the person to whom it is granted may practise as a

nurse, as the Board may impose.

(2) A person to whom a certificate of temporary registration has been granted shall, whilst such certificate or any renewal thereof is in force and such person complies with any conditions endorsed on the certificate or renewal thereof granted to such person, be deemed to be registered under this Act for the purposes of sections twenty-three, twenty-four, twenty-five, twenty-six, and twenty-seven only of this Act in the capacity specified in such certificate.

(3) (a) A certificate of temporary registra­ tion shall be in force for such period not exceeding twelve months as the Board may fix and may be renewed by the Board from time to time for a like period.

(b) The Board may, for any reason it deems fit, cancel any such certificate or renewal thereof, and thereupon such certificate or renewal shall cease to be in force.

(2) The amendments made by subsection one of this section shall commence upon the first day of January, one thousand nine hundred and sixty-one

(3) The person elected to the Board, the members of which are holding office upon the first day of January, one thousand nine hundred and sixty-one, pursuant to paragraph (g) of subsection one of section five of the Nurses Registration Act, 1953-1955, shall be deemed, as from the said day, to be a member of the Board for the purposes of the said paragraph (g) as substituted by subparagraph (ii) of paragraph (b) of subsection one of this section.

(4) The members of the Board first appointed pursuant to paragraphs (j), (k) and (1) of subsection one of section five of the Nurses Registration Act, 1953-1960, shall, notwith­ standing anything contained in the said Act, hold office for one year and be eligible for re-appointment.

(5) The subdivision of the Register of Nurses which immediately before the first day of January, one thousand nine hundred and sixty-one, was the Register of Mental Nurses shall as from the said day be the Register of Psychiatric Nurses and all persons who immediately before the said day were registered in the Register of Nurses as mental nurses shall subject to section seventeen of the Nurses Registration Act, 1953-1960, be deemed to be registered in the Register of Nurses as psychiatric nurses.

(6) The Roll of Assistants in Nursing as existing immediately before the first day of January, one thousand nine hundred and sixty-one, shall as from the said day be the Roll of Nursing Aides and all persons who immediately before the said day were enrolled in the Roll of Assistants in Nursing shall subject to subsection three of section twenty-two of the Nurses Registration Act, 1953-1960, be deemed to be enrolled in the Roll of Nursing Aides.
