Act No. 29, 1973.
An Act to provide for the constitution, and to define the powers, authorities, duties and functions, of the Nurses Education Board of New South Wales; and for purposes connected therewith. [Assented to, 2nd May, 1973.]
T IE it enacted by the Queen’s Most Excellent Majesty, by
and with the advice and consent of the Legislative
Council and Legislative Assembly of New South Wales in
Parliament ass^bled . and by the authority of the same, as
follows: —
1. This Act may be cited as the “Nurses Education short title.

“Board” means the Nurses Education Board of New South Wales constituted under this Act;
“member” means member of the Board;
“Nurses Registration Board” means the Nurses Registration Board constituted under the Nurses Registration Act, 1953.

| (2) | The Board shall consist of not less than ten nor |
more than twelve members appointed by the Governor, one of whom shall, in and by the instrument of his appointment, be appointed as the chairman.
( 3) Of the members—
| (a) | one shall be a person who is a member of the Nurses Registration Board and who is nominated for appointment to the Board by the Minister for Health; and |
(b)

the remainder shall be persons who are experienced No. 29,1973 or administration and who are nominated for appointment to the Board by the Minister after consultation with such persons and bodies as the Minister thinks fit.
(4) A member shall, subject to this Act, hold office for a term of three years and shall, if otherwise qualified, be eligible for reappointment.
(5) A person shall not be appointed as a member if he is of or above the age of seventy years.
(6) The provisions of the Public Service Act, 1902, shall not apply to the appointment of a member and a member shall not, in his capacity as a member, be subject to the provisions of that Act during his term of office.
(7) The office of a member shall not for the purpose of any Act be deemed to be an office or place of profit under the Crown.
5 . ( 1 ) A member ceases to hold office as a member and Vacation

there is a casual vacancy m ms office—
(a) if he dies;
| (b) | if he becomes a temporary patient or a continued treatment patient, a protected person or an incapable person within the meaning of the Mental Health Act, 1958, or a person under detention under Part VII of that Act; |
| (c) | if he resigns his office in writing under his hand addressed to the Governor and his resignation is accepted; |
(d )

| No. 29, 1973 | (d) | if he becomes bankrupt, applies to take the benefit of any law for the relief of bankrupt or insolvent debtors, compounds with his creditors or makes any assignment of his estate for their benefit; |
| (e) | if he is convicted in New South Wales of a felony or of a misdemeanour punishable by imprisonment for a period of twelve months or more, or if he is convicted elsewhere than in New South Wales of an offence that, if it were committed in New South Wales, would be a felony or a misdemeanour so punishable; | |
| (f) | if he is absent from three consecutive meetings of the Board of which reasonable notice has been given to him personally or in the ordinary course of post and is not, within six weeks after the last of those meetings, excused by the Board for his absence from those meetings; | |
| (g) | if, in the case of the member referred to in section 4 ( 3 ) (a), he ceases to be a member of the Nurses Registration Board; |
(h) if he is removed from office by the Governor; or
(i) upon his attaining the age of seventy years.
(2) The Governor may, for any cause which appears
to him sufficient, remove any member from office.
(3) A person appointed to fill a casual vacancy in the office of a member shall hold office for the balance of his predecessor’s term of office and is, if otherwise qualified, eligible for reappointment.

of development for nurse education in New South

| (b) | to initiate and maintain liaison with bodies pro viding educational courses for nurses, with the Nurses Registration Board and with the Health Commission of New South Wales; |
| (c) | to stimulate the provision of courses in nurse education in appropriate institutions; and |
| (d) | to foster research into matters relevant to the development and improvement of nurse education. |
(2) In the exercise of its functions, the Board shall have regard to the health service needs of the community, the nature of the courses and teaching facilities necessary to meet those needs and the resources available to the State.
7. ( 1 ) The Board may appoint such committees as it committees

| (2) Any such committee may consist of members of the Board, of persons who are not members of the Board or partly of persons who are, and partly of persons who are not, members of the Board. |
8. (1) The first meeting of the Board shall be convened Meetings
by the Minister in such manner and on such day as thegQ*j Minister deems fit. ’
(2) The procedure for the calling of meetings of the Board subsequent to the first meeting and for the conduct of business at those meetings shall be as determined by the Board.

| No. 29, 1973 | (3) The members of the Board shall elect from among their number a deputy chairman, who shall hold oflSce for such period, not exceeding his term of oflSce as a member, as the Board at the time of the election determines. |
| (4) At any meeting of the Board, the chairman or, in his absence, the deputy chairman shall preside, but if the chair man and the deputy chairman are both absent from that meet ing, a person elected from among their number by the members present shall preside at that meeting. | |
| (5) The person presiding at any meeting of the Board in accordance with subsection (4) shall have a deliberative vote and, in the event of an equality of votes, a casting vote. | |
| (6) Six members shall form a quorum at any meeting of the Board and any duly convened meeting of the Board at which a quorum is present shall be competent to transact any business of the Board and shall have and may exercise the functions of the Board. | |
| (7) A decision of a majority of the members present at a meeting of the Board at which a quorum is present shall be the decision of the Board. |
9. A member of the Board or of a committee shall be

The Board shall as soon as practicable, but not more than three months after the thirty-first day of December in each year, cause a report on its work and activities during the year ending on that day to be prepared and forwarded to the Minister for presentation to Parliament.
