320 (I1 tt 21t51axit'r ANNO VICESIMO QUARTO ELIZABETHAE SECUNDAE REGINAE No. 17 of 1975 An Act to validate the use for library purposes of land in Boyd Park Nundah in the City of Brisbane [ASSENTED T O 15 TH M AY, 19751 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same , as follows:- 1. Short title . This Act may be cited as the Nundah Library Validation Act 1975. 2. Validation of use. The use for library purposes as a function of local government of Brisbane City Council of that part of the land described in the Schedule which at the passing of this Act is being used for those purposes and the erection and use for library purposes as such a function of any building or other structure on that part are hereby declared to be lawful and shall be deemed always to have been lawful notwithstanding- (a) the City of Brisbane Town Planning Act 1964 - 1974 or the provisions of the Town Plan for the City of Brisbane continued in force by that Act or approved under that Act and in force at any material time; or (b) the omission by Brisbane City Council to comply with the provisions of any such Town Plan,

The use for library purposes as a function of local government of Brisbane City Council of that part of the land described in the Schedule which at the passing of this Act is being used for those purposes and the erection and use for library purposes as such a function of any building or other structure on that part shall be deemed to be and to have always been a use for a recreation purpose permitted by the conditions on which Brisbane City Council holds the land. 4.. M of term . In this Act the term " erection " includes the repair, maintenance, alteration and re-erection of a building or other structure and the making of additions to a building or other structure. SCHEDULE [ss. 2 and 3] That parcel of land containing 9 acres 29 perches be the same more or less situated in the County of Stanley Parish of Toombul described as Portion 737 being the whole of the land contained in Deed of Grant 136264 Volume 2852 Folio 24 and known as Boyd Park.
