An Act to permit nudity in certain public places.

BE IT ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):

1Short title and commencement

(1)This Act may be cited as the Nudity (Prescribed Areas) Act 1983.

(2)This Act shall come into operation on the day on which it receives the Royal Assent.

2Prescription of area by notice

(1)The Minister by notice published in the Government Gazette and after consultation with the council of the municipality within the municipal district of which the area proposed to be prescribed is situated—

(a)may prescribed an area to be an area to which this Act applies; and

(b)may in respect of an area prescribed under paragraph (a) prescribe times during which that area is to be an area to which this Act applies.

(2)The Minister may in a like manner revoke or amend a notice under subsection (1).

(3)The Minister shall within seven days of the publishing of—

(a)a notice under subsection (1); or

(b)the revocation or amendment of a notice under subsection (1)—

cause a copy of the notice, revocation or amendment to be published in a newspaper circulating generally throughout Victoria.

(4)A failure to comply with subsection (3) shall not affect the validity of the notice, revocation or amendment.

3Nakedness in a prescribed area

(1)A person does not by reason only of being naked in a prescribed area at a prescribed time commit an offence against a law in force in Victoria.

(2)For the purposes of subsection (1) prescribed area means an area prescribed under section 2 and prescribed time means a time prescribed under section 2 in respect of a prescribed area.
