NUDITY act 1975

An Act to permit nudity in certain areas

1Short title

This Act may be cited as the Nudity Act 1975.

2Definition

In this Act, free area means an area declared by regulations under this Act to be an area where nudity is permitted.

3Declaration of free areas

• (1)

  The Regulations may declare that a secluded area is an area where nudity is permitted.

• (2)

  Before an area is declared to be an area where nudity is permitted, the Administrator shall:

  • (a)

    give not less than 28 days notice, in the Gazette and in a newspaper circulating in the locality, of its intention to make a regulation so declaring that area;

  • (b)

    if the notice does not include a map indicating the proposed area, mark the boundaries of the proposed area on a map and display that map in a public place; and

  • (c)

    indicate the boundaries of the proposed area by signs displayed on or near these boundaries.

• (3)

  A notice given under subsection (2) shall be repeated 3 times during the period of 28 days after it is first given and shall, on each occasion on which it is given:

  • (a)

    describe the area proposed to be declared;

  • (b)

    if a map indicating the proposed area has been displayed, specify the place where the map may be inspected; and

  • (c)

    state that the boundaries of the proposed area have been indicated by signs displayed on or near those boundaries.

  4Approaches to free area

  The Minister shall cause the boundaries of, and the approaches to, a free area to be clearly marked with signs indicating that nudity is permitted within that area.

5Nakedness in a free area

A person is not guilty of an offence against a law in force in the Territory by reason only that he was nude in, or whilst swimming at, a free area.

6Lewdness, &c., in a free area

• (1)

  A person in, or in the waters or in the view of, a free area shall not behave in a manner that is sexually lewd or obscene.

  Maximum penalty:          4 penalty units or imprisonment for 6 months.

• (2)

  A person in, or in the waters or in the view of, a free area shall not behave in a manner or use language that is threatening, abusive, disorderly or sexually indecent.

  Maximum penalty:          1.5 penalty units or imprisonment for one month.

7Regulations

The Administrator may make regulations, not inconsistent with this Act, prescribing all matters required or permitted by this Act to be prescribed, or necessary or convenient to be prescribed, for carrying out or giving effect to this Act.
