Nuclear Non-Proliferation (Safeguards) Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Nuclear Non-Proliferation (Safeguards) Act 1987.

1.   Amendment

1.1   The Nuclear Non-Proliferation (Safeguards) Regulations are amended as set out in these Regulations.

Act 1901, s 48.]

2.   Regulation 2A (Prescribed international agreements)

2.1   Regulation 2A:

Omit “the Schedule”, substitute “Schedule 1”.

3.   New regulation 2B

3.1   After regulation 2A insert:

Supplementary Agency Agreements

 “2B.A Supplementary Agency Agreement mentioned in an item in Schedule 2 has effect, for the purposes of the Act, from the day mentioned in column 3 of the item.”.

4.   Regulation 3 (Nuclear material to which Part II of the Act does not apply

4.1   Subparagraph 3 (1) (g) (i):

After “of” insert, “the Agency Agreement or”.

4.2   Paragraph 3 (2) (c):

After “of” insert, “the Agency Agreement or”.

4.3   Paragraph 3 (3) (c):

After “of” insert, “the Agency Agreement or”.

5.   Schedule

5.1   Heading:

Omit the heading, substitute:

“SCHEDULE 1 Regulation 2A”

5.2   Item 1:

Omit the item.

5.3   Add at the end:

“5 Agreement between the Government of Australia and the Government of the United Mexican States concerning cooperation in Peaceful Uses of Nuclear Energy and the Transfer of Nuclear Material 28 February 1992”

6.   New Schedule 2

6.1   After Schedule 1, add:

 SCHEDULE 2 Regulation 2B
