AN ACT to amend the Noxious Weeds
Act, 1950-1959.
[Assented to 21st October, 1960.]
RE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—
Short title
| 1. (1) This Act may be cited as the Noxious | and citation. |
Weeds Act Amendment Act, 1960.
(2) In this Act the Noxious Weeds Act, 1950-
1959, is referred to as the principal Act.
(3) The principal Act as amended by this Act
may be cited as the Noxious Weeds Act, 1950-1960.

| amended. | 2. | Section twenty-two of the principal Act is |
amended by adding after subsection (2) a subsec-
tion as follows:
(2a) Where the Board intends to so direct by notice in writing pursuant to subsection (1) of this section, the Board shall at least seven days before the notice is served on the owner or occupier of the private land concerned or on both of them, give notice in writing of such its intention to the local authority in whose district the private land is situated.

| (a) | by publishing a copy of the notice in the Government Gazette not less than fourteen days before the date on which the measures to be taken by the owner or occupier to destroy the primary noxious weed as specified in the notice, shall commence; and |
| (b) | by publishing an abstract of the notice in a newspaper circulating generally in the district where the private land specified in the notice is situated, not less than fourteen days before the date so specified. |
(2) Any owner or occupier to whom the
notice is directed who
| (a) | does not forthwith after the date specified in the notice so served com- mence to comply therewith; or |
| (b) | having so commenced does not con- tinue such compliance, |
commits an offence.

Penalty: For a first offence twenty pounds,
and for any subsequent offence, fifty pounds.
(3) The notice may be directed to any
number of owners or occupiers of private land.
4. Section twenty-three of the principal Act is :acted.
amended by substituting for the words, "the last preceding section" in line four the words, "section twenty-two or twenty-two A of this Act."
