An Act to amend the Law relating to the Destruction of

Noxious Weeds.

W HEREAS it is desirable to amend the law relating to the Preamble.

destruction of noxious weeds-- Be it therefore Enacted by the Governor of the Province of' South Australia, with the advice and consent of the Legislative Council and House of Assembly of the said province, in this present Parliament assembled, as follows:

1, This Act shall be incorporated and read as one with '' The ~ncohoration.

Thistle and Bur Act of 1862," and " The Thistle and Bur Act,

1887."

2, I n the interpretation of this Act, the words " noxious weeds " Interpretation-

shall include all plants and noxious weeds for the destruction whereof any statutory provision is made; and the words local authority " shall mean any municipal corporation or district council. '

3. Whenever i t shall appear to the Commissioner of Crown Power to Commis-

part of the province, and that any statutory powers for securing the effectual destruction thereof have not been fully exercised, the Commissioner of Crown Lands shall give notice to the local authority having jurisdiction to exercise such powers in respect of the la.nd in question, requiring such local authority to exercise such powers in any manner which may be specified in such notice within a time, not being less than thirty days, to be limited by such notice; and

if within nuoh time such local authority shall not exercise such

powers the Commissioner of Crown Lands may himself exercise

such powers as if they had been originally conferred on him, and any

reasonable expense incurred by the Commissioner in the exercise of

such powers shall be a debt from the locd authority to the Commis-

sioner, and may be deducted from any grant payable to the local

authority pursuant to The District Councils and Corporations

Subsidy Act, 1890."

4. This Act may be cited as the a Noxious Weeds Destruction

Act, 1891."
