Act No. 172, 1985

An Act to amend the Noxious Insects Act 1934 to extend exemptions from rates under the Pastures Protection Act 1934 to special rates under the Noxious Insects Act 1934; and for other purposes. [Assented to, 3rd December, 1985.]

Noxious Insects (Amendment) 1985

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:

Short title

1.        This Act may be cited as the “Noxious Insects (Amendment) Act

1985”.

Commencement

2.         (1) Sections 1 and 2 shall commence on the date of assent to this

Act.

(2) Except as provided by subsection (1), this Act shall commence on the day appointed and notified under section 2 (2) of the Pastures Protection (Rates) Amendment Act 1985 for the commencement of Schedule 1 (3) to that Act.

Amendment of Act No. 22, 1934

3. The Noxious Insects Act 1934 is amended by omitting section 10(1)

and by inserting instead the following subsections:

(1) A board from time to time specified by proclamation published in the Gazette shall in each year commencing on 1 January make and levy a special rate, levied by service of a rate notice, of an amount prescribed in respect of that year on each owner or occupier of land that, within the meaning of the Pastures Protection Act 1934, is ratable land within the district of the board.

(1a) The provisions of sections 31-33, 35, 37-39 and 40a of the Pastures Protection Act 1934 apply to a special rate made under subsection (1) in the same way as they apply to a rate made under that Act.

(1b) Subsections (1) and (1a) do not apply to an owner or occupier

of ratable land exempted from the payment of the general rate under

the Pastures Protection Act 1934.

Transitional

4.        Nothing in this Act shall affect the payment, collection or recovery of

a special rate made and levied under section 10 of the Noxious Insects Act 1934 by a board within the meaning of the Pastures Protection Act 1934 before the commencement of this Act.
