An Act to amend the Noxious Insects Act, 1934, to remove the limitation on the amount of certain special rates and to make amendments by way of statute law revision. [Assented to, 28th November, 1979.]

Noxious Insects {Amendment).

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

1.          This Act may be cited as the “Noxious Insects Short title.

(Amendment) Act, 1979’’.

2. This Act contains the following Schedules :—

SCHEDULE 1.—Amendment to Section 10 of the

Noxious Insects Act, 1934.

SCHEDULE 2.—-Amendments to the Noxious Insects

Act, 1934, by way of Statute Law Revision.

3.          The Noxious Inseets Act, 1934, is amended in the manner Amendment

set forth in Schedules 1 and 2.

SCHEDULE 1.

Sec. 3.

Amendment to Section 10 of the Noxious Insects Act, 1934.

Section 10 (1) —

Omit “Such special rate shall not exceed three cents per head in the case of large stock and a half-cent per head in the case of sheep.”

Amendments to the Noxious Insects Act, 1934, by way of

Statute Law Revision.

(1) Section 2—

Omit “1912, or any Act amending or replacing the same” wherever occurring, insert instead “1934”.

(2) Section 7a

Omit “Under Secretary and Director” wherever occurring, insert instead “Director-General”.

(3) (a) Section 8 (3 )—-

Omit “subsection (1) of section 9”, insert instead

“section 9 (1 )”.

(b) Section 8 (4 )—

Omit “as amended by subsequent Acts,”.

Section 9 ( 1 ) —

Omit “Commissioner for Railways”, insert instead “Public

Transport Commission of New South Wales”.

(5) (a) Section 10 (1) —

Omit “1912, or under any Act amending or replacing the same”, insert instead “1934”.

(b) Section 10 (1)-

Omit “1912. or any Act amending or replacing the same”, insert instead “ 1934,”.

(6) (a) Section 11—

Omit “Colonial” wherever occurring.

(b) Section 11 (2)—

Omit “paragraphs (a) and (ai) of subsection (3 )”, insert instead “subsection (3) (a) and (a i)”.

(c) Section 11 (3) (ai)—

Omit “subsection (3) of section 8 or subsection (1) of section 9”, insert instead “section 8 (3) or 9 (1 )”.

(d) Section 11 (4)—

Omit “subsection (4) of section 8”, insert instead

“section 8 (4 )”.

(e) Section 11 (4)—

Omit “subsection (3) of that section”, insert instead

“section 8 (3 )”.

(7) (a) Section 11a (2) —

Omit “as amended by subsequent Acts,’

(b) Section 11a (2 )—

Omit “the said”, insert instead “those”.

(8) (a) Section 12-

Omit

Such regulations shall—

(a) be published in the Gazette;

(b)

take effect from the date of publication or from a later date specified in the regulations;

(c)

be laid before both Houses of Parliament within fourteen sitting days after the publication thereof if Parliament is in session, and if not, then within fourteen sitting days after the commencement of the next session.

If either House of Parliament passes a resolution of which notice has been given at any time within fifteen sitting days after such regulations have been laid before such House disallowing any regulation or part thereof, such regulation or part shall thereupon cease to have effect.

(b) Section 12 (2)—

At the end of section 12, insert ;—

(2) Section 41 of the Interpretation Act, 1897, applies in respect of a regulation made under this Act as if this Act had been passed after the commencement of the Interpretation (Amendment) Act, 1969.
