NORTHERN TERRITORY UNIVERSITY (STUDENT RESIDENCES) BY-LAWS

By-laws under the Northern Territory University Act

  1. Citation

    These By-laws may be cited as the Northern Territory University (Student Residences) By-laws.  (See back note 1)

  2. Definitions

    In these By-laws –

    "hall of residence" means –

    (a)      North Flinders International House;

    (b)      any other hall of residence established by the University; or

    (c)      any other accommodation provided by the University;

    "resident", in relation to a hall of residence, means a student or other person who is a resident of the hall of residence;

    "rule of conduct" means a rule made under by-law 3 prohibiting or regulating specified conduct of a resident or other person in a hall of residence.

  3. Rules

    (1)      The Council may make rules relating to the conduct of residents and other persons in halls of residence.

    (2)      Without limiting the generality of clause (1), the Rules may –

    (a)      provide for rules of conduct;

    (b)designate a contravention or failure to comply with a rule of conduct to be –

    (i)       a level 1 breach;

    (ii)      a level 2 breach; or

    (iii)     a level 3 breach;

    (c)provide for the procedure for imposing a penalty for a contravention or failure to comply with a rule of conduct; or

    (d)provide for the review of a decision to impose a penalty for a contravention or failure to comply with a rule of conduct.

  4. Penalties for breaches of rules of conduct

    (1)      A person must not contravene, or fail to comply with, a rule of conduct.

    (2)      The penalty that may be imposed for a contravention or failure to comply with a rule of conduct is not to exceed –

    (a)if the contravention or failure is designated a level 1 breach – $150;

    (b)if the contravention or failure is designated a level 2 breach – $300; or

    (c)if the contravention or failure is designated a level 3 breach – $500.
