Brennan CJ, Dawson and Toohey JJ reasoned that the comprehensive scheme established by the Commonwealth Act for the protection of Aboriginal land rights, including the process for claiming and granting such land, was inconsistent with the Northern Territory's power to grant mining tenements over that land. They found that the Commonwealth Act intended to preserve the status quo regarding mining on claimed land until the claim was determined, and that the Northern Territory Mining Act 1982 (NT) was invalid to the extent that it permitted the granting of such tenements. The Court therefore allowed the appeal, quashing the mining tenements granted by the Northern Territory.
