TRANSCRIPT OF PROCEEDINGS

BRENNAN CJ:   Is there any appearance for the parties in this matter?

The parties have indicated that they desire to rely upon their written submissions in this matter.  The Court has considered those submissions and proposes to grant special leave to appeal in this matter.  However, there are questions raised, especially in the written submissions by the first respondent, as to the jurisdiction of the Court.  The grant of special leave is not intended to preclude the raising of any question, whether of jurisdiction or otherwise, on the hearing of the appeal and, if it be appropriate on the hearing of the appeal, the Court can be moved for the rescission of the grant of special leave.

The formal order of the Court is that special leave be granted in this matter.

AT 9.57 AM THE MATTER WAS CONCLUDED
