REGULATIONS UNDER THE NORTHERN TERRITORY (ADMINISTRATION) ACT 1910-1962.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Northern Territory (Administration) Act 1910-1962.

Northern Territory Legislative Council (Fees, Allowances and Expenses) Regulations.

Citation.

1.These Regulations may be cited as the Northern Territory Legislative Council (Fees, Allowances and Expenses) Regulations.

Repeal.

2.The Northern Territory Legislative Council (Fees, Allowances and Expenses) Regulations (comprising Statutory Rules 1960, No. 10 and Statutory Rules 1963, No. 45) are repealed.

Commencement.

3. These Regulations shall be deemed to have come into operation on the first day of February, 1963.

Definitions.

4. In these Regulations—

“Electoral District” means an Electoral District of the Northern Territory the boundaries of which are prescribed by the Northern Territory Electoral Districts Regulations;

“meeting” means a meeting of the Legislative Council or of a Select Committee appointed by the Legislative Council.

Fees of elected and non-official members.

5. Each elected member and each non-official member of the Legislative Council shall receive a fee at the rate of Five hundred pounds per annum.

Electoral allowances for elected members.

6. An elected member of the Legislative Council shall receive an allowance in respect of discharging his duties—

(a) if he is a member for the Electoral District of Fannie Bay, Nightcliff or Port Darwin—at the rate of One hundred pounds a year;

(b) if he is a member for another Electoral District—at the rate of Two hundred pounds a year.

Travelling allowances of elected and non-official members.

7. Where an elected or a non-official member of the Legislative Council is absent from his home overnight by reason of his attendance at a meeting, the member shall receive travelling allowance of Six pounds six shillings for each day during which he is so absent from his home.

Telephone allowance of elected and non-official members.

8. Where, during a financial year, an elected or a non-official member of the Legislative Council makes trunk-line telephone calls for the purpose of attending to the business of the Legislative Council, the member shall receive—

(a) reimbursement of the cost of the charges incurred by him for those calls; or

(b) a telephone allowance of One hundred pounds, whichever is the less.

Travelling expenses of elected and non-official members.

9.—(1.) Where an elected or a non-official member of the Legislative Council makes a journey for the purpose of attending a meeting, or for the purpose of attending to business, of the Legislative Council, the Administrator may authorize in respect of the whole, or such part as he considers reasonable, of the journey—

(a) the reimbursement to the member of the cost of his fare for so much of the whole, or the part, of the journey as was made by public transport;

(b) the reimbursement to the member of the cost of transporting his excess baggage by public transport up to and including thirty-five pounds weight; and

(c) the payment to the member of a mileage allowance, in accordance with the following table, for so much of the whole, or the part, of the journey as was made by means of a motor vehicle not engaged in public transport:—

(2.) The Administrator may authorize the payment, in respect of travelling by an elected member or non official member within his Electoral District in his capacity as a member, and in respect of travelling by such a member on one visit in a year to a part of the Territory other than the Electoral District that the member represents—

(a) if the member travels by public transport—of an amount equal to the amount paid by him for his fares; and

(b) if the member travels by a motor vehicle not engaged in public transport—of an amount calculated in accordance with the table in paragraph (c) of the last preceding sub-regulation.

(3.) The Administrator may authorize the reimbursement to an elected or a non-official member of the whole, or such part as he considers reasonable, of the cost of the fare of the wife of a member (other than a member for the Electoral District of Fannie Bay, Nightcliff or Port Warwin) as was made by public transport for one visit a year to Darwin for the purpose of accompanying her husband to a meeting of the Legislative Council.

Members and non-official members not entitled to double payment of travelling allowances and expenses.

10. Notwithstanding anything contained in these Regulations, where an elected or non-official member of the Legislative Council is entitled to receive payment of either—

(a) a travelling allowance under regulation 7 of these Regulations in respect of a day; or

(b) travelling expenses under the last preceding regulation in respect of a journey,

he shall not also be entitled to payment of travelling allowance in respect of the day or travelling expenses in respect of the journey, as the case may be, under the Northern Territory Administrator’s Council (Fees, Allowances and Expenses) Regulations.
