NORTHAMPTON LANDS

RESUMPTION

No. 16 of 1948.

AN ACT to resume certain land in the Northampton

Road District, and for other relative purposes.

[Assented to 18th November, 1948.]

BE it enacted by the King's Most Excellent Majesty,by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows :—

This Act may be cited at the Northampton Lands Resumption Act, 1948, and shall come into operation on a mencement.

2.    Upon the commencement of this Act, the land ilreirrion

described in the Schedule to this Act shall revest in His Majesty as of his former estate, freed and discharged from all estates (as defined in section four of the Inter- pretation Act, 1918-1938, and including mineral rights), trusts and obligations whatsoever.

Act or in respect to any estate, whether legal or equitable in, over, to or in respect of the land resumed or any part thereof, and no action or proceeding shall lie by or on behalf of any person for any such compensation : provided, however, that the Governor may in his dis- cretion make to any person who shall claim compensation within the time and in the manner provided in section

four of this Act, an ex gratia payment out of the Con-

solidated Revenue Fund of such sum (if any) as he

shall think fit.

Claims for

Any claim for an ex gratia payment under the provisions of section three of this Act shall be made in writing to the Minister for Lands within one year from the commencement of this Act, and the claim shall state

payment.

(a)

the area and description of the land or portion

thereof in respect to which the claim is made;

(b)

the nature and particulars of the estate in respect to which the claim is made, with full particulars of the nature and extent of the claim;

(c)

the name in full and the address of the person

on whose behalf the claim is made ; and

(d)

the names and addresses of all other persons (if any) known or believed by the claimant td have or to claim any estate with reference to the said land or any part thereof.

SCHEDULE.

All that piece of land coloured green on the map on Certificate of Title, Volume 1068, Folio 925, containing 376 acres 36 perches, or thereabouts, and being portion of each of Victoria Locations 27, 37, 183, 324 and 325, and being the whole of the land comprised in the said Certificate of Title, Volume 1068, Folio 925.
