AN ACT to enable the Municipality of Northam to con- struct, maintain, and work Ice Works and Cool Storage Plant.

[Assented to 8th November, 1921.;

BE it enacted by the King's Most Excellent Majesty, byCouncil and Legislative Assembly of Western Australia, inand with the advice and consent of the Legislative

this present Parliament assembled, and by the authority of

the same, as follows:—

Short title.

1.    This Act may be cited as the Northam Municipal Ice

Works Act, 1921.

2.    (1.) The Municipality of Northam is hereby authorised ,A,Loctil% teoarcro;;m

and empowered—

(a) to construct, maintain, and work ice works and cool

storage works and plant;

(b) to purchase or otherwise acquire land for the pur- pose of erecting thereon ice works and cool storage works and plant, and for use in connection there- with; and for such purpose the provisions of sec- tion two hundred and nineteen of the Municipal Corporations Act, 1906, shall apply;

(c) to manufacture, purchase, sell, supply, and deliver, either within or without the boundaries of the dis- trict of the said municipality, ice, and ice-chests or other things pertaining to the use of ice;

(d) To carry on the business of the cool storage of goods and to make such charges for the use of space in such cool storage works as the Council of the said Municipality may from time to time determine;

(e) to commence, prosecute, enforce, or defend all actions and other proceedings and demands relating to the said ice works and cool storage works and plant and the powers conferred on the said Municipality by this Act, and to compromise or refer to arbitra- tion any such action, proceeding, or demand.

(2.) Subject as hereinafter provided, such works and un- dertakings shall be deemed to be works and undertakings within the meaning of Part XXIV. of the Municipal Corpora- tions Act, 1906.

Borrowing powers.

The Northam Municipal Council may at any time, and from time to time, under and subject to this Act and Part XXIV. of the Municipal Corporations Act, 1906, as modified by this Act, borrow on the credit of the said municipality any sum or sums of money which may be necessary for the pur- pose of carrying out the works and undertakings authorised by this Act; but the total sum to be borrowed shall not at any time exceed Five thousand pounds.
