VALIDATION.

AN ACT to validate the expenditure of certain Moneys expended by the Mayor and Councillors of the Municipality of Northam.

Preamble.

HEREAS by a resolution passed at a meeting of

Wthe Northam Municipal Council held on the fifth

day of September, one thousand nine hundred and thirty- five, the mayor and councillors authorised the expendi- ture out of funds of the Northam Muncipal Council of moneys up to a total sum of six hundred pounds and thereafter expended the sum of six hundred pounds pur- suant to an arrangement made between the Northam Road Board, the Commissioner of Main Roads, and the said Northam Municipal Council as the said council's proportion of the cost of reconditioning and dressing that portion of York road, commonly known as Ceme- tery road, situated outside the boundary of Northam municipal district but between such boundary and Nor- tham public cemetery, within the Northam road district: And whereas the said expenditure upon and in connec- tion with the said works was for the benefit and credit of and advantageous to the municipality of Northam and to the owners and occupiers of rateable land situ- ate within such municipality, but because the said works were executed and carried out upon a road situated out-

side of the Northam municipal district doubts have been expressed concerning the authority and the power of the mayor and councillors of the municipality of Northam to authorise the expenditure of and to expend the moneys of the Northam Municipal Council as hereinbefore men- tioned: And whereas it is necessary and desirable to re- solve such doubts and to validate the said expenditure: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and- by the authority of the same, as follows:-

1.    This Act may be cited as the Northam Municipal Short title:-

Council Validation Act, 1936.

2.    (1.) Notwithstanding anything to the contrary Zugar

contained in the Municipal Corporations Act, 1906, or in any other Act, the appropriation and expenditure by the mayor and councillors of the municipality of Northam pursuant to the resolution in that behalf passed at a meeting of the Northam Municipal Council held on the fifth day of September, one thousand nine hundred and thirty-five, of moneys up to a total sum of six hundred pounds out of the revenue or funds of the Northam Municipal Council towards or on account of the cost of reconditioning and dressing with bitumen that portion of York road, commonly known as Cemetery road, situ- ated within the Northam road district between the boun- dary of the Northam municipal district and the Northam cemetery is hereby validated, authorised and confirmed-

(2.) No action or other legal proceedings whatsoever shall be instituted in any court of law for or on account of the appropriation and expenditure of the said sum of six hundred pounds .or any part thereof for or on account of the purpose aforesaid against any person who is or has been the mayor or a councillor of the munici- pality of Northam or in the employment of the Northam Municipal Council.
