However, the Court also held that Mr. Binks' intoxication was a significant contributing factor to the accident. Applying principles of negligence and causation, the Court determined that the Council was liable, but that Mr. Binks' damages should be reduced to reflect his contributory negligence. The appeal was allowed in part, with the original judgment being set aside and a new judgment entered for the plaintiff in a reduced amount.
