An Act relating to certain Land at North Melbourne.

Preamble

WHEREAS by a Crown grant dated the third day of October One thousand eight hundred and seventy certain land in the borough of Hotham (hereinafter referred to as "the granted land") was granted to the mayor councillors and burgesses of the said borough (who and whose successors are hereinafter referred to as the "grantees") subject to the condition among others that the granted land should at all times thereafter be used for a town hall borough offices and court house:

AND WHEREAS by a lease dated the twenty-seventh day of April One thousand eight hundred and eighty-two the grantees leased certain rooms or offices on part of the granted land to Her Majesty the Queen for post and telegraph offices a court house and other offices and conveniences:

AND WHEREAS Act number eight hundred and thirty-eight validated the said lease and empowered the grantees to lease the part of the granted land described in the Schedule to that Act:

AND WHEREAS the said lease is now held by the Commonwealth of Australia:

AND WHEREAS it is expedient that the power conferred by the said Act to lease the land described in the Schedule thereto should be extended to another part of the granted land which is not now required for the purposes specified in the said Crown grant or any other municipal purposes:

AND WHEREAS the said other portion of the granted land together with the land described in the Schedule to the said Act is the land described in the Schedule to this Act:

AND WHEREAS the remaining portion of the granted land is now being used for a baby health centre elderly citizens club public hall municipal library and municipal offices and it is expedient that the use thereof for those purposes or other municipal purposes should be sanctioned:

AND WHEREAS the said borough was duly constituted a town under the provisions of the Local Government Act 1874 and later was united with the City of Melbourne pursuant to the Local Government Amendment Act 1889 and the corporation of the City of Melbourne became entitled to the grant of land pursuant to section nine of the last-mentioned Act:

BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):

1.Short title

This Act may be cited as the North Melbourne Municipal Buildings Site Act 1963.

2.Power to City of Melbourne to lease land described in Schedule

(1)The Lord Mayor councillors and citizens of the City of Melbourne may subject to and in accordance with the provisions of section one of Act number eight hundred and thirty-eight grant leases of the land described in the Schedule to this Act or any part thereof and the provisions of sections two and three of that Act shall apply to and in relation to any such lease and the said land and any part thereof.

(2)All moneys received by the said Lord Mayor councillors and citizens as rent for any of the said land so leased shall go to and form part of the town fund of the City of Melbourne.

3.Power to use remaining land for municipal purposes

Notwithstanding anything in the hereinbefore recited Crown grant the Lord Mayor councillors and citizens of the City of Melbourne may, subject to the hereinbefore recited lease, use the land comprised in the said Crown grant for any works services or installations which they are empowered to undertake or provided by or under the Local Government Act 1958 or any Act relating to the corporation of the City of Melbourne.

SCHEDULE

Land, including the land described in the Schedule to Act No. 838, which may be demised by the corporation of the City of Melbourne.

Two roods, 9⁴/₁₀ perches, at North Melbourne, Parish of Jika Jika, County of Bourke, being part of allotment 10, section 2.

Commencing at the north-western angle of allotment 14 section 2; bounded thence by Errol-street bearing 0° 0' 155 feet 10¼ inches; by lines bearing 90° 5' 102 feet 11 inches, 180° 28' 20 feet 9¾ inches and 90° 8' 61 feet 5¼ inches; by allotments 9, 7 and 6 bearing 181° 5' 5 feet 9¾ inches and

179° 35' 129 feet 2¼ inches, and thence by allotment 14 bearing

270° 16' 47 feet 3 inches and 270° 1' 117 feet 9 inches to the point of commencement.
