BRENNAN CJ:   This matter was heard in Canberra by the whole Court.  On 8 February 1996 an order was made granting the applicants special leave to appeal from the whole of the judgment of the Full Court of the Federal Court of Australia given on 1 November 1995.

The appeal was allowed, the orders of the Full Court set aside and orders made in lieu thereof.  It was then said that the reasons would follow in due course. 

I now publish the joint reasons of Justices Dawson, Toohey, Gaudron, Gummow and myself.

McHUGH J:   I publish my reasons for granting the application for special leave to appeal and allowing the appeal.

KIRBY J:   I publish my reasons for granting the application for special leave to appeal and for allowing the appeal.
