1 Name
This Ordinance is the Norfolk Island Legislation Amendment (Fees) Ordinance 2018.
2 Commencement
(1) Each provision of this Ordinance specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3 Authority
This Ordinance is made under section 19A of the Norfolk Island Act 1979.
4 Schedules
Each instrument that is specified in a Schedule to this Ordinance is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Ordinance has effect according to its terms.

1 After item 44 of Schedule 4
Insert:
44A Subsection 608(2)
After “or any other Act”, insert “, any other law in force in the Territory of Norfolk Island”.
44B At the end of section 610
Add:
Note: This section does not apply to a law continued in force by section 16 or 16A of the Norfolk Island Act 1979 as such a law is not an Act for the purposes of this section.

Add:
12BA Special rules relating to fees for services provided by the Norfolk Island Regional Council
(1) The Norfolk Island Regional Council may, in accordance with Part 10 of Chapter 15 of the Local Government Act 1993 (NSW) (NI), determine the amount of one or more fees for a service provided by the Council despite an enactment.
(2) If the Norfolk Island Regional Council does so, then:
(a) an enactment has no effect to the extent that that Part is inconsistent (within the meaning of section 18A of the Norfolk Island Act 1979) with the enactment; and
(b) the fee or fees payable for the service are the fees determined under that Part, despite an enactment.

375 Application of amendments relating to fees
Subsection 12BA(2) of the Interpretation Act 1979 (Norfolk Island), as inserted by the amending Schedule, applies in relation to a service provided on or after 1 July 2018 (whether or not an application or request for the service is made before, on or after that day).
