NON-CONTENTIOUS PROBATE AMENDMENT RULES 1996

Made by the Judges of the Supreme Court.

Citation

1. These rules may be cited as the Non-contentious Probate Amendment Rules 1996.

Principal rules

2. In these rules the Non-contentious Probate Rules 1967* are referred to as the principal

rules.

Rule 38 repealed and a rule substituted

3. Rule 38 of the principal rules is repealed and the following rule is substituted-

"

Form of grant, etc

38. Grants of probate, letters of administration, letters of administration with the will annexed and orders to administer shall be in such form as the Registrar from time to time directs.

Rule 39 repealed and a rule substituted

4. Rule 39 of the principal rules is repealed and the following rule is substituted-

"

Requirements as to documents

39. Documents for filing in the Registry shall comply with the requirements of

Order 69 Rule 2 of the Rules of the Supreme Court 1971.

Rules 40 and 41 repealed

5. Rules 40 and 41 of the principal rules are repealed.

First Schedule amended

6. The First Schedule to the principal rules is amended by deleting Forms 6, 7, 8,9 and 10.
