(Penalty Notice) Regulation 1997

Justices Act 1902

His Excellency the Lieutenant-Governor, with the advice of the Executive Council, has made the following Regulation under the Justices Act 1902.

Explanatory note

The object of this Regulation is to prescribe section 131 (Penalty notices) of the Rural Fires Act 1997 as a prescribed provision of an Act for the purposes of the definition of penalty notice in Part IVB of the Justices Act 1902. The amendment will apply the system for dealing with offences set out in Part IVB to offences under the Rural Fires Act 1997 and regulations prescribed under section 131 of that Act.

This Regulation is made under the Justices Act 1902, including sections 100I and 154 (the general regulation making power).

1 Name of Regulation

This Regulation is the Justices (General) Amendment (Penalty

Notice) Regulation 1997.

2 Commencement

This Regulation commences on 1 September 1997.

3 Amendment of Justices (General) Regulation 1993

The Justices (General) Regulation 1993 is amended as set out in

Schedule 1.

The explanatory note does not form part of this Regulation.

Clause 19

Insert after clause 18:

19 Definition of “penalty notice” (sec 1001)

For the purposes of the definition of penalty notice in section 100I (1) of the Act the following is a prescribed provision:

Rural Fires Act 1997, section 131.
