Nguyen v Condo

The plaintiffs sought a declaration that they had acquired a beneficial interest in property owned by the defendants, and an order for compensation for the diminution in value of their interest. The defendants counterclaimed for the return of a tractor and the payment of outstanding expenses. The plaintiffs alleged that they had been promised a one-half share in the defendants’ property, and that they had relied on this promise by making expenditures to establish and maintain a vineyard on the property. The defendants denied that they had promised a one-half share to the plaintiffs and argued that any agreement was unenforceable due to delays by the plaintiffs in prosecuting their claim. The court was required to determine whether the plaintiffs were entitled to equitable relief based on the doctrine of equitable estoppel.

The court held that the plaintiffs had established the elements necessary to found an equitable estoppel. The plaintiffs had made expenditures in reliance on the defendants’ assurances that they would transfer a one-half share in the property to the plaintiffs. The defendants had allowed the plaintiffs to grow vegetables on the property in respect of which the plaintiffs retained all the income to assist them in generating the funds to establish the vineyard. The plaintiffs had acted to their detriment by making these expenditures in reliance on the defendants’ assurances. The defendants had also failed to take reasonable steps to disabuse the plaintiffs of their reliance on the assurances. The court held that the plaintiffs were entitled to equitable relief.

The court ordered that the defendants pay the plaintiffs $217,761 in equitable compensation, together with interest of $157,119 from 31 December 2006 to the date of judgment. The total amount of $374,880 was charged on the defendants’ property. The court dismissed the defendants’ counterclaim and adjourned the issue of costs to a later date.
