The defendants had also failed to take reasonable steps to disabuse the plaintiffs of their reliance on the assurances. The court held that the plaintiffs were entitled to equitable relief.

The court ordered that the defendants pay the plaintiffs $217,761 in equitable compensation, together with interest of $157,119 from 31 December 2006 to the date of judgment. The total amount of $374,880 was charged on the defendants’ property. The court dismissed the defendants’ counterclaim and adjourned the issue of costs to a later date.
