An Act to enable the Prothonotary of the Supreme Court or his Deputy to perform certain duties wi th respect to the pr in t ing and publishing of Books and Newspapers. [27th December, 1852.]
WH E R E A S an Act was passed by the Governor and Legislative of His late Majesty King George the Fourth and numbered two which Council of New South Wales in the eighth year of the reign
Act was amended by certain other Acts of the said Governor and Council passed in the second and fifth years of Her present Majesty's reign numbered twenty and nineteen respectively And whereas by the said first recited Act as so amended certain affidavits or affirma tions were directed to be taken and made before and delivered to the Colonial Secretary for the time being of the said Colony and certain other matters and things touching newspapers and other papers therein mentioned were therein required to be done by the said Colonial Secretary And whereas by a certain other Act of the said Governor and Council passed in the eighth year of the reign of His said late Majesty and numbered five it was enacted that every person having any printing press or types for printing should cause a notice thereof to be delivered to the Colonial Secretary for the time being who was by the said Act required to register and file the same and to grant to the person giving such notice a certificate of such notice having been so delivered And whereas by an Act of the Governor and Legislative Coun cil of New South Wales passed in the thirteenth year of the reign of Her present Majesty and numbered forty-seven it was provided that after the first day of January then next every affidavit and affirmation notice

newspaper or other paper and document which by the said recited Acts or any of them was required to be taken or made before or delivered to the said Colonial Secretary or some person on his behalf should in lieu thereof be taken or made before or delivered to the Registrar of the Supreme Court of New South Wales or to the Chief Clerk in his Office and whereas there is now no such Officer of the said Supreme Court as Registrar and there is consequently no such person as the Chief Clerk in his Office Be it therefore enacted as follows :—
1. That after the passing of this Act every affidavit and affirma tion notice newspaper or other paper and document which by the Acts hereinbefore mentioned or any of them is required to be taken or made before or delivered to the Registrar of the Supreme Court of New South Wales or the Chief Clerk in his Office shall in lieu thereof be taken or made before or delivered to the Prothonotary of the Supreme Court of New South Wales or shall be taken or made before or delivered to one of the Clerks in the said Supreme Court authorized in that behalf by the said Prothonotary to take and receive the same and every affidavit and affirmation taken made or delivered to the said Prothonotary or to the said Clerk and every certified copy of any affidavit or affirmation under the hand of such Prothonotary or Clerk respectively and every paper or document delivered in accordance with the provisions of the said Acts or any of them and every notice relating to any printing press or types for printing so delivered as aforesaid and every certificate granted by the said Prothonotary or Clerk respec- tively (as the case may require) of the due delivery of such notice shall respectively have the like force and effect and be subject to the like conditions in all respects as if the same respectively had been taken or made before or delivered to or granted by the Registrar of the Supreme Court of New South Wales or the Chief Clerk in his Office.
