Act No. 67, 1902.

An Act to consolidate the enactments for making more effectual provision for paving certain streets of the City of Newcastle and for the licensing and regulation of public vehicles

within the said city. [5th September, 1902.]
BE advice a n d consent of t h e Legis la t ive Council and Legis la t ive
i t enac ted by t h e K i n g ' s Mos t Exce l l en t Majes ty , by a n d wi th t h e
Assembly of N e w South W a l e s in P a r l i a m e n t assembled, and by the

au thor i ty of t h e same, as follows :—

P R E L I M I N A R Y .

1. This Ac t m a y be cited as t h e " Newcas t le P a v i n g and P u b l i c
Vehicles R e g u l a t i o n Act , 1 9 0 2 , " and is divided in to Pa r t s , as follows :—

2. (1) The Act t h i r ty -n ine Victor ia n u m b e r th i r ty-s ix is hereby

repealed.

( 2 ) Al l by-laws made u n d e r t h e au tho r i t y of t he A c t hereby

repealed a n d in force a t t he t ime of t h e pass ing of th is Ac t shall

con t inue in force a n d be deemed to have been made hereunder .

( 3 ) Eve ry license g ran ted u n d e r t he A c t hereby repealed or

unde r any by- law m a d e the reunder , and subsis t ing a t the t ime of t he pass ing of th i s Act , shal l have force and effect as if this A c t had been in force a t t h e t ime i t was g r an t ed and i t had been g ran ted hereunder or unde r

a by-law m a d e he reunder , and th is A c t shall app ly to i t accordingly.

(4) Eve ry p lan and specification prepared by t h e surveyor of t h e counci l unde r t h e Ac t hereby repealed and h a v i n g any force or effect a t t he t i m e of t he pass ing of this A c t shall have force and effect as if th i s A c t h a d been in force a t t h e t ime they were prepared and they had been p repa red hereunder , a n d this A c t shall apply to t h e m accordingly.

( 5 ) E v e r y not ice given u n d e r t he au tho r i t y of t h e A c t hereby

repealed, and h a v i n g any force or effect a t t h e t ime of t he pass ing of th i s Act , shall have force and effect as if th is Ac t h a d been in force a t t he t ime i t was given and it had been given hereunder , and th is Ac t shall apply to i t accordingly.

3 . I n th i s Act , unless t h e con tex t or sub jec t -mat te r otherwise
indicates or r equ i r e s ,—
" c o u n c i l " means t h e munic ipa l counci l of t he borough of Newcas t l e ;
" c o u n c i l c l e rk" means t h e council clerk of the bo rough of

N e w c a s t l e ;

" mayor " means t he mayor of the borough of N e w c a s t l e ;
" o w n e r " m e a n s any person h a v i n g t h e immedia te beneficial

in teres t in any house or land ;

" publ ic vehicles " means a n y s tage-carr iage or omnibus , as defined

b y a n y by- law unde r th is Act , hackney carr iage, coach, car,
cabriolet , waggon, cart , van , dray , or o ther vehicle p ly ing
for h i re wi th in t he borough of Newcas t le , a n d d r a w n by one
or more horses or o ther an imals . P A R T I I .
P W E M E N T S .
4 . (1) The counci l shall cause a not ice in t h e form or to the effect

of t he First Schedule here to , signed by the council clerk a n d dated the day of i ts service, to be left a t each house in t he streets of t he borough of Newcas t le described in t he Second Schedule hereto, a long the footway

adjoining wh ich—
(a) t h e ke rb ing has been p e r m a n e n t l y laid b u t no notice has been
given u n d e r t he Ac t hereby repealed ; or (b)
(b) t h e ke rb ing is hereaf ter pe rmanen t ly laid, r equ i r ing such

footway to be paved w i t h such mater ia ls and in such m a n n e r as m a y be men t ioned in such not ice in every case where such footway is unpaved after such k e r b i n g is so laid.

(2) Such not ice shall, i n t h e case of every occupied house, be left w i th some i n m a t e thereof, and in the case of every unoccupied house, be nai led or posted upon some conspicuous pa r t thereof.

(3) A copy of every such not ice shall be k e p t in t h e office of t h e counci l or of t h e counci l clerk, and be open to t h e inspect ion of every ci t izen of t he said city free of cha rge a t all t imes after service thereof as aforesaid.

5. Every footway t h a t is not paved according to t he uni form p l an

and specification prepared as here inaf ter ment ioned , shall be deemed to

be u n p a v e d for t h e purposes of th is Act .

6 .     (1) I f t h e owner of a n y house a t which such not ice as afore­

said has been du ly left, does not, w i th in t h r e e m o n t h s thereaf ter ,

comply w i t h such not ice by pav ing t h e footway adjoining t h e said house as hereinbefore ment ioned according to some uni form p lan and specification to be previously p repared by the surveyor of t h e council and k e p t in t h e office of t h e council or of t he council clerk, t he council shall for thwi th cause such p a v i n g to be done a n d keep an exac t accoun t of t h e expense thereof in a book.

(2) T h e said p l a n and specification and t h e said book shall

be open to t h e inspect ion of every cit izen of t he said city free of charge.

7 . (1) The counci l shall , w i t h i n t h i r t y days after any such

pav ing has been completed by t h e m adjoining any house, cause an accoun t of t h e cost thereof to be left a t such house, in t h e same m a n n e r in which t h e said notices are hereinbefore directed to be left.

(2) I f t h e owner of such house does not , wi th in four teen

days after such accoun t has been so left, p a y to t h e council c lerk a t his office t h e a m o u n t of such account , t h e counci l may , by w a r r a n t u n d e r the

h a n d of t h e mayor and in t he fo rm or to the effect of t he Thi rd Schedule

here to , dis t ra in upon t h e goods found in such house for t he said a m o u n t ,

and dispose of t h e same in l ike m a n n e r as is now prescr ibed by law
wi th respect to ra tes distrained for by order of t h e council .

(3) I f such goods be long to any t enan t and not to t h e owner of such house, such t e n a n t m a y deduct t h e a m o u n t which he pays on such distress be ing m a d e from any rents due or to be paid to his immedia te landlord, or m a y sue his immed ia t e landlord or t h e owner of such house for any damage he sustains by non-paymen t by such owner of t h e cost of m a k i n g such p a v e m e n t as aforesaid, and t h e l ike r ights of deduct ion and suit arc hereby given to every in te rmedia te t enan t aga ins t his immedia te landlord or t he said owner.

(4) Provided t h a t no such t e n a n t shall be ent i t led to

commence a n y action agains t his immedia te landlord or t he said owner,

unless

unless he has handed over to such landlord or owner respectively the
notice and account hereinbefore mentioned as soon as practicable after
the receipt of the same.

8. W h e n and so often as any pavement of any footway requires any repairs the council shall forthwith take the like steps and shall exercise the same powers and use the same form of notice and warrants as are hereinbefore directed and given to them with respect to paving in the first instance, and the tenant shall have the like remedies against his immediate landlord or the owner as aforesaid.

9. W h e n any distress is made for any such sum of money to be levied under the authority of this A c t , the distress itself shall not be deemed unlawful, nor shall the party making the same be deemed a

trespasser ab initio, on account of any subsequent irregularity committed
by the party distraining, but the person aggrieved by such irregularity
may recover full satisfaction for the special damage in an action on the
case.

10. The costs of levying or making any distress under this A c t

shall be those set forth in the Fourth Schedule hereto, and no other.

P A R T I I I .

PUBLIC VEHICLES.

11. (1) The council may make by-laws—

(a) regulating the mode of licensing and controlling public vehicles and the drivers and conductors thereof within the borough of Newcast le;
(b) fixing and appointing the hours within which owners, drivers, and conductors of public vehicles respectively shall exercise
their calling ;
(c) fixing and appointing the ages at which drivers and conductors

of public vehicles may be employed;

(d)

prescribing the badges (if any), clothing, or uniform to be worn by such drivers and conductors respectively ;

(e)

prescribing the number, description, equipment, furniture, and gear of public vehicles ;

(f)

limiting the number of persons to be earned in public vehicles;

(g)

prescribing the size and dimensions of stage-carriages, omni­ buses, and cars;

(h) fixing and appointing the numbers and positions of public
stands for public vehicles ; (i)

(i)    fixing and appo in t ing t h e a m o u n t to he paid for fares for t ime

or dis tance for t he use of pub l i c veh ic l e s ;
(j) p rov id ing for t h e safe cus tody of any proper ty wh ich may be
accidenta l ly or otherwise left in publ ic veh ic l e s ;
(k)
p roh ib i t ing a n y misconduc t on t h e p a r t of t he owners, drivers ,
or conductors of publ ic vehicles, or of o ther persons a t t e n d i n g

to or m a n a g i n g such vehicles, w h e t h e r b y demand ing or receiving more t h a n the au thor ised fare or for not per forming

s tated j ou rneys in t h e appoin ted t ime , or o the rwi se ;
(I)
p roh ib i t ing persons h i r i n g pub l i c vehicles f rom f raudulen t ly
evad ing t h e p a y m e n t of the au thor i sed fares ; and
(m)
w i th respect to all o ther ma t t e r s a n d th ings connected wi th

t h e good gove rnmen t and regu la t ion of publ ic vehicles.

(2) N o l icense fee shal l be imposed by a n y such by- law

exceeding t h e respect ive sums specified in t he F i f th Schedule here to .

(3) The counci l may , by such by- laws , impose penal t ies for

any breaches thereof, b u t no such pena l ty shal l exceed for any one

offence t h e s u m of t e n pounds .

(4) Such by-laws shall , w h e n confirmed by the Governor

and publ ished in t h e Gazet te , have t h e force of law.

( 5 ) T h e produc t ion of t he Gazet te w i th any such by- law

conta ined the re in shall in any sui t or proceeding whatsoever be evidence of such by- law h a v i n g been du ly made , confirmed, and publ ished as aforesaid.

( 6 ) Al l such by- laws and all a l tera t ions a n d repeals thereof

shall, wi th in four teen days of t h e confirmation thereof by the Governor, be laid before bo th Houses of Par l i ament , if t h e n in session, and if not , t h e n wi th in t h e first four teen days of t he n e x t ensu ing session thereof.

1 2 . Al l fines, penalt ies , and forfeitures incurred unde r a n y by­
laws m a d e hereunder , m a y be recovered in a s u m m a r y m a n n e r before
a n y two just ices accord ing to t h e provisions of t h e Jus t i ces Act , 1902,
and any A c t a m e n d i n g t h e same, and shall be paid to the counci l c lerk
or t reasurer of t h e council .

1 3 . A l l fines, penal t ies , and forfeitures recovered or received

unde r any by- laws m a d e he reunder , and also al l sums of money received

for l icensing publ ic vehicles, and all o ther income from wha teve r source ar is ing shall be paid to t h e council c lerk who shall keep separate accounts of t h e moneys so received, and such moneys shal l be applied by the counci l in p a y m e n t of any expenses necessarily incur red in car ry ing this A c t into effect, a n d for t he improvement and benefit of t he said borough.
