I, the Minister for Planning, make the following local environmental plan under the

Environmental Planning and Assessment Act 1979. (N08/00141/PC-1)

Environmental Planning and Assessment Act 1979

1      Name of Plan

This Plan is Newcastle Local Environmental Plan 2003 (Amendment

No 8).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Aims of Plan

This Plan aims to amend Newcastle Local Environmental Plan 2003 so

as:

(a)	to rezone part of the land to which this Plan applies from Zone 2 (b) Urban Core Zone to Zone 3 (b) District Centre Zone to allow development to occur that would otherwise be prohibited, and
(b)	to rezone part of the land to which this Plan applies from Zone 2 (a) Residential Zone to Zone 2 (b) Urban Core Zone to remove split zoning of lots, and
(c)	to rezone part of the land to which this Plan applies from Zone 2 (b) Urban Core Zone to Zone 2 (a) Residential Zone to remove split zoning of a lot, and
(d)	to rezone part of the land to which this Plan applies from Zone 2 (b) Urban Core Zone to Zone 3 (a) Local Centre Zone to remove split zoning of a lot and maintain the local centre zone along Regent Street, New Lambton, and
(e)	to rezone part of the land to which this Plan applies from Zone 6 (a) Open Space and Recreation Zone to Zone 7 (a) Conservation Zone to provide an appropriate zone for the protection of bushland, and
(f)	to rezone part of the land to which this Plan applies from Zone 5 (b) Special Uses Reservation Zone to Zone 7 (a)

Conservation Zone to enable an appropriate zone for surplus

Government land, and

(g) to rezone the remaining land to which this Plan applies from Zone 7 (a) Conservation Zone to Zone 5 (b) Special Uses Reservation Zone (marked “Arterial Road”) to enable the reservation of land for future State Government infrastructure.

4      Land to which Plan applies

(1)

In respect of the aim referred to in clause 3 (a), this Plan applies to

certain land at Mayfield, being:

(a)	Lots 175, 173, 165 and 164, Section L, DP 975643, 1, 5, 10 and 12 Hewson Street, and
(b)	Lots 11–14, Section F, DP 3626, 2, 4, 6 and 8 Hewson Street, and
(c)	Lot 174, DP 731657, 3 Hewson Street, and
(d)	Lot 1, DP 197017 and Lot 1, DP 783265, 2 and 4 Havelock Street, and
(e)	Lots 177 and 176, Section L, DP 975643, 6 and 8 Havelock Street, and
(f)	Lots 6, 5 and 4, Section F, DP 3626, 10, 12 and 14 Havelock Street, and
(g)	Lots 2 and 1, DP 37351, 1 and 3 Thomas Street, and
(h)	certain unnamed laneways,

as shown edged heavy black and lettered “3 (b)” on Sheet 1 of the map marked “Newcastle Local Environmental Plan 2003 (Amendment No 8)” deposited in the office of Newcastle City Council.

(2)	With respect to the aim referred to in clause 3 (b), this plan applies to part of Lot 14, DP 1123626, 6 Irrawang Street, Wallsend and part of Lot 252, DP 1107294, 9 Mawson Street, Shortland, as shown edged heavy black and lettered “2 (b)” on Sheets 2 and 4, respectively, of that map.
(3)	With respect to the aim referred to in clause 3 (c), this plan applies to part of Lot 251, DP 1107294, 29 Guam Street, Shortland, as shown edged heavy black and lettered “2 (a)” on Sheet 3 of that map.
(4)	With respect to the aim referred to in clause 3 (d), this plan applies to part of Lot 76, DP 1111382, 48 Regent Street, New Lambton, as shown edged heavy black and lettered “3 (a)” on Sheet 5 of that map.
(5)	With respect to the aim referred to in clause 3 (e), this plan applies to Lot 11, DP 1063164, 471A Brunker Road, Adamstown, as shown edged heavy black and lettered “7 (a)” on Sheet 6 of that map.

(6)	With respect to the aim referred to in clause 3 (f), this plan applies to Lot 5, DP 1016931, 299 City Road, Merewether, as shown edged heavy black and lettered “7 (a)” on Sheet 7 of that map.
(7)	With respect to the aim referred to in clause 3 (g), this Plan applies to certain land at Lambton, New Lambton Heights, Jesmond, Wallsend, Elermore Vale and Rankin Park, as shown edged heavy black, lettered “5 (b)” and marked “Arterial Road” on Sheet 8 of that map.
