An Act to sanction the carrying out of certain Harbour Improvements at Newcastle, in the county of Northumberland. [30th

April, 1889]

WH E R E A S , cer tain proposed P u b l i c W o r k , namely : — " C e r t a i n works of

p u r s u a n t to t he " P u b l i c W o r k s A c t of 1888 ," a

H a r b o u r I m p r o v e m e n t s , inc lud ing Sh ipp ing facilities at Newcas t l e "

was, on t h e twen ty - four th day of J u l y , in t he year one thousand e ight

h u n d r e d and e ighty-e ight , duly submi t t ed a n d expla ined by t h e

Secretary for Pub l i c W o r k s in t he Legis la t ive Assembly, and. such work was thereupon referred, on t he motion of the said Minis ter , to the Pa r l i amen ta ry S tand ing Commit tee on Public; W o r k s , which Commit tee repor ted thereon to t he said Assembly in the following te rms , n a m e l y : — " T h a t t he Commit tee consider it expedient t h a t t he H a r b o u r Improve ­ m e n t s a t Newcas t le , as proposed on the p lan and explained in t he evidence before t he Commit tee , be carried o u t " ; A n d whereas on the seventh day of November , in t he year one thousand e ight hundred and e ighty-eight , t he said Assembly by resolut ion declared " t h a t in

accordance wi th t h e R e p o r t f rom the P a r l i a m e n t a r y S tanding Com­

mi t t e e on Pub l ic W o r k s , i t is expedient t h a t cer ta in H a r b o u r Improve ­

m e n t s a t Newcast le , referred to t h e Commit tee for inqui ry , be carr ied

out a t a to ta l es t imated cost of One h u n d r e d and twelve thousand

p o u n d s " ; A n d the said resolut ion was notified in t h e Gazette on t he

e ighth day of November , in t he said year ; A n d whereas, p u r s u a n t to

t h e said Act , it has become t h e d u t y of t he Minis te r to in t roduce a Bill in to t he said Assembly to sanct ion the car ry ing out of such work as aforesaid ; Be it therefore enacted by t h e Queen ' s Most Exce l len t Majes ty , by and wi th the advice; and consent of t he Legislative; Counci l and Legis la t ive Assembly of N e w South Wales in Pa r l i amen t assembled, and by the au thor i ty of t he same, as fo l lows:—

1. This A c t may be cited as the " N e w c a s t l e H a r b o u r Improve ­

men t s A c t of 1889 ," and shall be read with the " P u b l i c Works Act

of	1888 ."

2.    The Pub l ic W o r k more par t icu lar ly described in the Schedule

to th i s A c t shall be carried out by t he Secretary for Pub l i c W o r k s , or t he M e m b e r of the Execu t ive Council for t h e t ime being charged wi th

t he duties of t h e said Minis ter . A n d such Minis ter or M e m b e r

shall for t he purposes of this A c t and the " ' P u b l i c Works A c t of

1888 " be deemed and t aken to be t he " C o n s t r u c t i n g A u t h o r i t y " author ized to en te r into contracts , and to exercise all powers, do all acts and th ings , a n d bo responsible in respect of all obligations a n d liabilit ies which can be done or incurred by a " C o n s t r u c t i n g A u t h o r i t y " u n d e r or pu r suan t to th is Ac t or t he said Pub l ic W o r k s Ac t , so far as m a y be necessary for t he car ry ing ou t of t he work hereby sanctioned. T h e plan of such work in th i s A c t referred to is t he p lan marked " Newcas t le H a r b o u r I m p r o v e m e n t s , " signed by the Secretary for Pub l i c W o r k s , a n d counters igned by t h e A c t i n g Engineer- in-Chief for H a r b o u r s and Rivers , and deposited in t he office of t he Secretary for

P u b l i c W o r k s .
3. The cost of car ry ing out of the work hereby sanctioned

shal l be defrayed from such Loan Votes as arc now or m a y hereafter

4 . On comple t ion of t h e work he reby sanct ioned, t he same or

any por t ion thereof, shall , by notification in t h e Gazette by t h e Governor, be t ransferred to and vested in such A u t h o r i t y or person, on behalf of H e r Majesty , as, h a v i n g regard to t h e n a t u r e of t he work or

a n y por t ion thereof, t he Governor shal l de termine .
