NEWCASTLE HARBOUR IMPROVEMENTS ACT.

Act No. 6 ,1953 .

An Act to sanction and to provide for the carry­ ing out of certain works in and adjacent to Newcastle Harbour; to amend the Public Works Act, 1912, as amended by subsequent Acts, and certain other Acts; and for pur­ poses connected therewith. [Assented to, 25th September, 1953.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legis­ lative Council and Legislative Assembly of New South

Wales in Parliament assembled, and by the authority of the same, as follows:—

1 . This Act may be cited as the "Newcastle Harbour Improvements Act, 1953."

2. In this Act the expression "Newcastle Harbour" includes all that part of the Hunter River and its estuary downstream of the road-bridge over the Hunter River at Hexham.

3 . (1) (a) The carrying out of the work described in the Schedule to this Act is hereby sanctioned.

(b) The said work shall be deemed to be an authorised work within the meaning of the Public Works Act, 1912, as amended by subsequent Acts.

empowered to carry out the said work and shall be the Constructing Authority for the same within the meaning of the said Act, as so amended, and shall enter into such contracts, and take all such necessary steps for the proper execution thereof as such Authority may think proper. (d)
(c) The Minister for Public Works is

(d) The provisions of the Public Works Act,

1912, as amended by subsequent Acts, sections thirty-
four, thirty-five, thirty-six and thirty-seven excepted,
shall apply to and in respect of the said work.

(2) Without prejudice to the generality of subsec­ tion one of this section, the provisions of section thirty- eight of the Public Works Act, 1912, as amended by subsequent Acts, shall apply to and in respect of any contracts referred to in paragraph (c) of subsection one of this section.

4 . The plan of the said work is the plan marked "Newcastle Harbour Improvements Proposed Reclama­ tion of Is lands" signed by the Minister for Public Works and countersigned by the Director of Public Works, and deposited in the public office of the said Minister.

5 . The estimated cost of carrying out the said work (exclusive of land resumptions) is four million four hundred and sixty thousand pounds, and such estimated cost shall not in any circumstances be exceeded by more than ten per centum.

6 . For the purposes of this Act, and not otherwise, the Public Works Act, 1912, as amended by subsequent Acts, is hereby amended by omitting from subsection three of section ninety-eight the words "fifty y e a r s " and by inserting in lieu thereof the words "ninety-nine years" .

SCHEDULE.

IMPROVEMENT works in or adjacent to Newcastle Harbour for mitiga­
tion of floods, improvement of facilities for navigation and

reclamation comprising—

(a)

dredging the North and South Arms of the Hunter River for purposes of flood mitigation and improved navigation;

(b)

improvement and embellishment of Ash, Dempsey, Walsh, Moscheto and Hexham Islands and low lying land adjoining the foreshores of Newcastle Harbour, including reclamation of any such land by deposit thereon of dredged spoil or such other materials as may be available from time to time;

(c)

(c)

works of river regulation along the North and South Arms of the Hunter River and at the southern end of Walsh Island;

(d)

construction of pipe-head jetties, embankments and all works incidental to or rendered necessary by the deposit of spoil on the land hereinbefore described;

(e)

construction of roads and drainage channels on the land hereinbefore described;

(f)

other incidental works deemed necessary or desirable by the Constructing Authority.

The whole of the works hereinbefore described shall be subject to such modifications as may be deemed necessary or desirable by the Constructing Authority.
