INDUSTRIAL ASSOCIATION

(AMENDMENT) ACT.

Act No. 28, 1936.

An Act to amend the Newcastle Agricultural, Edward vm.

Horticultural, and Industrial Association Act of 1905, and certain other Acts in certain respects; and for purposes connected

therewith. [Assented to, 4th July, 1936.]

_I3 by and with the advice and consent of the Legis­

lative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

1. This Act may be cited as the “ Newcastle Agricul- Short title,

tural, Horticultural, and Industrial Association (Amend­

ment) Act, 1936.”

2 . The Newcastle Agricultural, Horticultural, and	Amendment
of Private

Industrial Association Act of 1905 is amended— Act of 1905.

(a) by omitting from section one the words “ convey and transfer the same to the mortgagee, his heirs,	Sec. 1.	•

executors, administrators, or assigns, freed and for ever discharged from any trust or dedication affecting the same; and the said lands so conveyed or transferred shall vest in the mortgagee, freed and discharged from any trust or dedication affecting the same as aforesaid” and by inserting in lieu thereof the words “ execute any necessary" instruments” ;

(b) by inserting at the end of the same section th§ following new subsections:—

(2) A mortgage under this Act may contain a power of sale.

_L ' (3) AVliere a mortgage is given pursuant to this Act the land comprised in such mortgage shall, in the hands of the mortgagee and of any

■ person claiming through or under him, be freed and discharged from any trust or dedication affecting such land.

Consequen- 3 . The Xewcastle Agricultural, Horticultural, and mentroTi'ct I^idustrial Association (Extension) Act, 1925, is

by inserting in section two after the figures “ 1905” the words and figures “ as amended l)v the Newcastle Agricultural, Horticultural and Industrial Association (Amendment) Act, 1936” ;

(b)

by inserting in the same section after the Avords

“ the said provisions” the words “ as so

amended.”
