His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the New South Wales Lotteries Act 1990.

Explanatory note

The object of this Regulation is to authorise NSW Lotteries to conduct the game of Powerball. Powerball is a national game which will be conducted in conjunction with other States and Territories. Prizes are awarded on the basis of the selection of 5 numbers- from one group of numbers and a single number from a second group of numbers.

The game is to be conducted under similar arrangements applying to games of lotto or keno. The game, to the extent that it is considered to be a public lottery, does not comply with the general regulations under the New South Wales Lotteries Act 1990 relating to draw lotteries. The Regulation therefore excludes those general regulations and applies provisions similar to games of lotto and keno.

The Regulation is made under section 42 of the New South Wales Lotteries

Act 1990.

1 Name of Regulation

This Regulation is the New South Wales Lotteries (General)
Amendment (Powerball) Regulation 1996.

2 Amendment of New South Wales Lotteries (General) Regulation 1995

The New South Wales Lotteries (General) Regulation 1995 is amended as set out in Schedule 1.

Part 4A Powerball

27A Definition of powerball

In this Part:

powerball means a game in which prizes are awarded on the basis of the selection of 5 numbers from one group of numbers and a single number from a second group of numbers.

27B Application of Part

This Part applies to any game of powerball that is a public lottery for the purposes of the Act.

Schedule 1 Amendments

27C Authority of NSW Lotteries

NSW Lotteries is authorised to promote and conduct the game of powerball if it is authorised to do so by a licence issued by the Minister under this clause and it complies with the conditions of the licence.

27D Rules of game

(1)

Powerball is to be conducted in accordance with rules approved by the Minister and published in the Gazette.

(2)

The Minister is to ensure that the rules of the game of powerball are consistent with the conduct of the game on a national basis.

27E Application of other general regulations

(1) Parts 2, 3 and 4 do not apply to the game of powerball,
except as provided by subclause (2).
(2) Clause 27 applies to a game of powerball in the same
way as it applies to a draw lottery.
